      The Army Discharge Review Board reviewed your case and determined

                         PART IV - PREHEARING REVIEW

                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  The evidence of record shows that on 17 April 1998, the applicant
was charged with AWOL (970514-980415).  On 17 April 1998, the applicant
consulted with legal counsel and voluntarily requested, in writing,
discharge under the provisions of Chapter l0, AR 635-200 in lieu of trial
by court-martial.  In this request, the applicant admitted guilt to the
offense, or a lesser included offense.  Further, the applicant indicated
that he understood that he could receive an under other than honorable
conditions discharge and that the discharge would have a significant effect
on eligibility for veteran’s benefits.  The applicant did not submit a
statement in his own behalf.  The unit commander recommended approval of an
under other than honorable conditions discharge.  On 22 February 1999, the
separation authority approved the discharge with an under other than
honorable conditions discharge.

      b.  On 8 September 1999, the applicant was discharged.  At the time
of discharge, the applicant had completed 1 year, 8 months, and 12 days of
active military service (to include 509 days excess leave) and accrued 337
days of lost time due to AWOL in the period under review.

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter l0 of that regulation provides, in pertinent part, that a member
who has committed an offense or offenses for which the authorized
punishment includes a punitive discharge may submit a request for a
discharge for the good of the service in lieu of trial by court-martial.
The requests may be submitted at any time after charges have been preferred
and must include the individual’s admission of guilt.  Army policy states
that although an honorable or general discharge is authorized, a discharge
UOHC is normally considered appropriate.

        (2)  The issue is accepted.  The Board carefully examined the
applicant’s record of service during the period of enlistment under review.
 There was a full consideration of all faithful and honorable service as
well as the infraction of discipline, the extent thereof, and the
seriousness of the offense.  The Board does not condone the applicant’s
misconduct; however, determined that the discharge is now inequitable.
Notwithstanding the propriety of the applicant’s discharge, the Board noted
that because the applicant was in an entry-level status, the approving
authority had two options as to characterization of service.  One option
was to characterize the applicant’s service as under other than honorable
conditions and the other was not to characterize the applicant’s service.
Given the evidence of the applicant’s serious family difficulties and his
exemplary achievements since his discharge, the Board determined that it
would be more equitable to now uncharacterize the applicant’s service.
Accordingly, the Board voted to grant  relief by changing the
characterization of service to uncharacterized and to change the narrative
reason for discharge to Secretarial Authority.  This action entails a
change in RE code to 1.

    Inasmuch as the Board voted to grant the full relief requested,
response to the remaining issue is neither required nor rendered.
