Applicant departed AWOL on 000108 while on IADT status. He was
subsequently DFR’d on 000207. Per applicable regulations, he was
discharged from the USARNG and assigned to the USAR Control Group,
effective 000202. He was further released from attachment and assigned to
his RA unit, effective 000207.
PART IV - PREHEARING REVIEW
SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:
a. The evidence of record shows that on 27 September 2000, the
applicant was charged with AWOL from (8 January–13 September 2000). On 27
September 2000, the applicant consulted with legal counsel and voluntarily
requested, in writing, discharge under the provisions of Chapter l0, AR 635-
200 in lieu of trial by court-martial. In this request, the applicant
admitted guilt to the offense, or a lesser included offense. Further, the
applicant indicated that he understood that he could receive an under other
than honorable conditions discharge and that the discharge would have a
significant effect on eligibility for veteran’s benefits. The applicant
did not submit a statement in his own behalf. The applicant also requested
to be placed on indefinite excess leave pending completion of his
administrative discharge proceeding under Chapter 10, AR 635-200. His
request was approved and he was placed on excess leave status, effective 28
September 2000. The unit commander recommended approval of an under other
than honorable conditions discharge. The separation authority approved the
discharge with an under other than honorable conditions discharge.
b. On 21 February 2002, the applicant was discharged. At the time
of discharge, the applicant had completed 1 year, 7 months, and 16 days of
active military service (which included 512 days of excess leave), and
accrued 249 days of lost time in the period under review. The applicant
had a total of 2 years, 5 months, and 14 days of total military service.
2. Legal/Regulatory Basis for Separation Action: Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter l0 of that regulation provides, in pertinent part, that a member
who has committed an offense or offenses for which the authorized
punishment includes a punitive discharge may submit a request for a
discharge for the good of the service in lieu of trial by court-martial.
The requests may be submitted at any time after charges have been preferred
and must include the individual’s admission of guilt. Army policy states
that although an honorable or general discharge is authorized, a discharge
under other than honorable conditions is normally considered appropriate.

a. Propriety: The applicant has not submitted an issue of
propriety and the ADRB has not otherwise relied upon an
issue of propriety to change the discharge.
b. Equity: The parenthetical number(s) below correspond(s) to
the issue number(s) on the DD Form 293, or in Part VI,
Paragraph 1, above.
(2) The issue is accepted. The Board carefully examined the
applicant’s record of service during the period of enlistment under review
and heard his testimony. The Board does not condone the applicant’s
misconduct; however, determined that the characterization of service
granted is inequitable. The Board noted that the applicant was in entry-
level status when he departed his unit in an AWOL status. Upon his return
to military control the applicant was charged with AWOL and voluntarily
requested discharge under the provisions of Chapter 10, AR 635-200, in lieu
of trial by court-martial. In essence the applicant’s only had completed 2
months of continuous creditable active duty service and was still an entry-
level status soldier. Command had the option to characterize his service
under other than honorable conditions or to describe his service as
uncharacterized. Notwithstanding the propriety of the applicant’s
discharge, the Board concluded that the applicant’s service should now be
described as uncharacterized. Accordingly, the Board voted to grant
partial relief by changing the description of the applicant’s service to
uncharacterized. The Board determined that the reason for discharge was
both proper and equitable and voted not to change it.
(1) The issue is rejected. The Board determined that the
applicant was in an entry-level status when he returned to military
control. A general discharge is not authorized under entry-level status
conditions. A fully honorable discharge may be granted only in cases which
are clearly warranted by unusual circumstances involving outstanding
personal conduct and/or performance of duty. The Board determined that no
such unusual circumstances were present in the applicant’s record and his
service did not warrant an honorable discharge. See response to issue (2)
above.
