PART IV - PREHEARING REVIEW
SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:
a. The specific facts and circumstances pertaining to the
applicant’s discharge are not contained in the available records. The
record contains a properly constituted DD Form 214 (Certificate of Release
or Discharge from Active Duty) which was signed by the applicant. His DD
Form 214 indicates that he was discharged under the provisions of Chapter
14, AR 635-200 by reason of misconduct – commission of a serious offense,
with a general, under honorable conditions characterization of service,
Separation Code of “JKQ” and RE Code of 3. The applicant submitted a DA
Form 4430-R (Department of the Army Report of Result of Trial) showing that
on 26 July 2000 he was convicted by a Summary Court-Martial of two
specifications of failing to obey a written order. He was sentenced to
confinement for 30 days, a reduction to private/E1, and a forfeiture of
$670 pay per month for one month. The applicant also submitted a copy of
the intermediate commander’s recommendation that the applicant receive an
honorable discharge, and a memorandum from his unit commander to the
Redstone Arsenal MILPO requesting expeditious out-processing for the
applicant due to his father’s terminal illness.
b. On 13 October 2000, the applicant was discharged. At the time of
discharge, the applicant had completed 1 year and 27 days of active
military service in the period under review.
2. Legal/Regulatory Basis for Separation Action: Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter l4 establishes policy and prescribes procedures for separating
members for misconduct. Specific categories include minor disciplinary
infractions, a pattern of misconduct, commission of a serious offense, to
include abuse of illegal drugs, convictions by civil authorities and
desertion or absence without leave. Action will be taken to separate a
member for misconduct when it is clearly established that rehabilitation is
impractical or unlikely to succeed. Army policy states that an under other
than honorable conditions discharge is normally considered appropriate, but
a general discharge under honorable conditions or an honorable discharge
may be granted.

a. Propriety: The applicant has not submitted an issue of
propriety and the ADRB has not otherwise relied upon an
issue of propriety to change the discharge.

(2) The issue is accepted. The Board carefully examined the
available record of service during the period of enlistment under review.
There was a full consideration of all faithful and honorable service as
well as the infractions of discipline, the extent thereof, and the
seriousness of the offenses. Although the Board does not condone the
applicant’s misconduct, the Board determined that there were sufficient
mitigating circumstances to overcome the discrediting entries in his
service record. In addition, the Board noted that the intermediate
commander, after reviewing the circumstances in the applicant’s case,
recommended that he receive an honorable discharge. Given the above
factors, the Board determined that the discharge granted is now
inequitable. Accordingly, the Board voted to grant partial relief in the
form of an upgrade of characterization of service to fully honorable and to
change the narrative reason for discharge to Secretarial Authority.
(1) The issue is rejected. The Board determined that the
applicant’s RE code of 3 was properly based on his record of service. An
RE Code of 3 indicates that the applicant requires a waiver prior to being
allowed to reenlist. If the applicant desires to reenlist, he should
contact the local recruiter to determine his eligibility to reenlist.
Those individuals can best advise a former service member as to the needs
of the Army at the time, and are required to process waivers of RE codes.
