                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  Evidence of record shows that on 26 July 1990, Orders 207-154,
DA, HQ, US Army Armor Center, Fort Knox, Kentucky, discharged the applicant
from the regular Army, effective date: 1 August 1990.  The record contains
a properly constituted DD Form 214 (Certificate of Release or Discharge
from Active Duty).  His DD Form 214 indicates that he was discharged under
the provisions of Chapter 10, AR 635-200, for the good of the service-in
lieu of court-martial with a characterization of service of under other
than honorable conditions.  Furthermore, the DD Form 214 shows a Separation
Code of KFS (i.e., for the good of the service-in lieu of court-martial)
with an RE code of 3.  The specific facts and circumstances leading to the
applicant’s discharge are not contained in the available records.

      b.  On 1 August 1990, the applicant was discharged.  At the time of
discharge, the applicant had completed 1 year, 2 months, and 15 days of
active military service and accrued 490 days of lost time in the period
under review and had a total of 10 years, 2 months and 12 days of active
military service.

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter l0 of that regulation provides, in pertinent part, that a member
who has committed an offense or offenses for which the authorized
punishment includes a punitive discharge may submit a request for a
discharge for the good of the service in lieu of trial by court-martial.
The requests may be submitted at any time after charges have been preferred
and must include the individual’s admission of guilt.  Army policy states
that although an honorable or general discharge is authorized, a discharge
under other than honorable conditions is normally considered appropriate.

        (2)  The issue is accepted.  The Board carefully examined the
available record of service during the period of enlistment under review.
While the Board does not condone the applicant’s misconduct, it determined
that the characterization of service is now inequitable.  The Board found
that the applicant’s misconduct was mitigated by the overall length and
quality of his service and the time that has elapses since his discharge.
Accordingly, the Board voted to grant relief in the form of an upgrade of
characterization of service to general, under honorable conditions.  The
Board determined that the reason for discharge was both proper and
equitable and voted not to change it.
