                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  The specific facts and circumstances pertaining to the
applicant’s discharge are not contained in the available records.  The
available evidence of record shows that on 6 February 2003, DA, Camp Casey
Transition Center, APO AP, Orders 037-003 discharged the applicant from the
Regular Army, effective 20 February 2003.  The record contains a properly
constituted DD Form 214 (Certificate of Release or Discharge from Active
Duty) which was authenticated by the applicant.  His DD Form 214 indicates
that he was discharged under the provisions of Chapter 5, Paragraph 5-10,
AR 635-200, with an honorable characterization of service.  His DD Form 214
also shows that he was discharged by reason of his alien status and
received full involuntary separation pay of $18,171.

      b.  On 20 February 2003, the applicant was discharged.  At the time
of discharge, the applicant had completed 5 years and 6 months of active
military service in the period under review and had a total of 7 years, 11
months and 29 days of active military service.

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter 5 establishes policy and prescribes procedures for separating
aliens not lawfully admitted to or residing in the United States who did
not conceal their true citizenship status at enlistment.  The character of
service will reflect service rendered by the individual after enlistment.

      a.  Propriety:   The applicant has not submitted an issue of
                   propriety and the ADRB has not otherwise relied upon an
                   issue of propriety to change the discharge.

                   Paragraph 1, above.

        (1)  The issue is rejected.  The applicant’s record is void of
facts and circumstances concerning events that led to a discharge from the
Army.  The Board noted that the applicant’s record contains a properly
constituted DD Form 214 (Certificate of Release or Discharge from Active
Duty) which was authenticated by the applicant.  The Board noted the
applicant’s contentions; however, Army Regulation 601-280, Chapter 3,
Paragraph 3-8a(b)(c), stipulates that aliens who have in excess of 8 years
of Federal military service are disqualified from further service if they
have not been lawfully admitted to the United States for permanent
residence.  The applicant served the maximum allowable time of 7 years, 11
months, and 29 days and would have been disqualified for further service if
he had not attained permanent residence status.  In the absence of evidence
to the contrary, the Board presumed government regularity in the discharge
process. The applicant’s issue regarding access to federal benefits is not
within the purview of this Board.  The Board, being convinced that the
reason for discharge was both proper and equitable, voted to deny relief.
