                         PART IV - PREHEARING REVIEW

                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  The evidence of record shows that on 18 July 2002, the unit
commander notified the applicant of initiation of separation action under
the provisions of Chapter l3, AR 635-200, by reason of unsatisfactory
performance, with a general, under honorable conditions discharge.  The
reasons for the proposed action were the applicant received a company grade
Article 15 for failing to obey a lawful regulation, damaging US government
property, and damaging property of the government of Germany.  He received
another company grade Article 15 for two specifications of failing to be at
the time prescribed to his appointed place of duty.  He was advised of his
rights.  The applicant waived his right to consult with legal counsel, was
advised of the impact of the discharge action, and on 23 July 2002, he
submitted a statement in his own behalf.  The unit commander subsequently
recommended waiver of further rehabilitative efforts.  On 3 August 2002,
the proper legal authority reviewed the discharge action and found it
legally sufficient.  On 7 August 2002, the separation authority waived
further rehabilitative efforts and directed that the applicant be
discharged with a general, under honorable conditions discharge.

      b.  On 27 August 2002, the applicant was discharged.  At the time of
discharge, the applicant had completed 1 year, 10 months, and 26 days of
active military service in the period under review.

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter 13 contains the policy and outlines the procedures for separating
individuals for unsatisfactory performance, and provides, in pertinent
part, that commanders will separate a member under this chapter when, in
the commander's judgment, the member will not develop sufficiently to
participate satisfactorily in further training and/or become a satisfactory
soldier.  Army policy states that a general discharge, under honorable
conditions is normally considered appropriate, but an honorable discharge
may be granted in meritorious cases.

      a.  Propriety:   The applicant has not submitted an issue of
                   propriety and the ADRB has not otherwise relied upon an
                   issue of propriety to change the discharge.

      b.  Equity:      The parenthetical number(s) below correspond(s) to
                   the issue number(s) on the DD Form 293, or in Part VI,
                   Paragraph 1, above.

        (1)  The issue is rejected.  The Board carefully examined the
applicant’s record of service during the period of enlistment under review.
 There was a full consideration of all faithful and honorable service as
well as the incidents of unsatisfactory performance.  The Board noted the
applicant’s contentions; however, did not find said contentions
sufficiently mitigating to warrant an upgrade of the discharge under
review.  Further, if the applicant desires to reenlist, he should contact
his local recruiter to determine his eligibility to reenlist.  Those
individuals can best advise a former service member as to the needs of the
Army at the time, and are required to process waivers of reentry
eligibility (RE) codes.  The Board determined that the applicant's
discharge was appropriate because the quality of his service was not
consistent with the Army's standards for acceptable personal conduct and
performance of duty by military personnel.  By his poor duty performance,
the applicant diminished the quality of his service below that meriting a
fully honorable discharge.  The applicant provided no independent
corroborating evidence demonstrating that either the command's action was
erroneous or that the applicant’s service mitigated the poor duty
performance.  The Board, being convinced that the reason for discharge and
the characterization of service were both proper and equitable, voted to
deny relief.
