SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:
a. All the specific facts and circumstances leading to the
applicant’s discharge are not contained in the available records. The
evidence of record shows that on 19 December 2001, the applicant was
charged with conspiring with two junior enlisted soldiers to make a false
official statement regarding the accountability of sensitive military items
(15 October 2001); derelict in the performance of his duties by willfully
failing to stay with his military vehicle when he was left to guard it (15
October 2001); derelict in the performance of his duties in that upon
discovering the loss of sensitive items belonging to a soldier under his
leadership, he willfully failed to immediately report the loss to his chain
of command (15-16 October 2001); and with intent to deceive, made a false
official statement to a member of the military police concerning the lost
sensitive military equipment, two specifications (17 October 2001). The
applicant’s voluntarily request for discharge in lieu of court-martial is
not in the available records. The unit and intermediate commander
recommended approval of an under other than honorable conditions discharge.
On 8 January 2002, the separation authority approved the discharge with an
under other than honorable conditions discharge. The record contains a
properly constituted DD Form 214 (Certificate of Release or Discharge from
Active Duty), authenticated by the applicant’s signature. His DD Form 214
indicates that he was discharged under the provisions of Chapter 10, AR 635-
200, by reason of in lieu of court-martial, with a characterization of
service of under other than honorable conditions. Furthermore, the DD Form
214 shows a Separation Code of KFS (i.e., in lieu of court-martial), with a
reentry code of 3.
b. On 2 February 2002, the applicant was discharged. At the time of
discharge, the applicant had completed 1 year, 11 months, and 8 days of
active military service in the period of service under review. He had a
total of 15 years, 1 month, and 24 days of total military service.
2. Legal/Regulatory Basis for Separation Action: Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter l0 of that regulation provides, in pertinent part, that a member
who has committed an offense or offenses for which the authorized
punishment includes a punitive discharge may submit a request for a
discharge for the good of the service in lieu of trial by court-martial.
The requests may be submitted at any time after charges have been preferred
and must include the individual’s admission of guilt. Army policy states
that although an honorable or general discharge is authorized, a discharge
under other than honorable conditions is normally considered appropriate.

(1) The issue is accepted. The Board carefully examined the
applicant’s record of service during the period of enlistment under review
and heard his testimony. There was a full consideration of all faithful
and honorable service as well as the alleged infractions of discipline, the
extent thereof, and the seriousness of the offenses. Notwithstanding the
propriety of the applicant’s administrative separation process, the Board
determined that the outcome of said process yielded an inequitable
discharge. The applicant and his counsel provided creditable testimony
describing the inconsistencies by command in the enforcement of command
policies. The Board was convinced that these inconsistencies by command
tainted the resulting investigation and led command to deal more severely
with the applicant than others involved in the misconduct. Further, the
Board was convinced that the applicant’s apprehension about getting a fair
and just trial led to his requesting discharge in lieu of trial by court-
martial. The Board also noted that the incidents resulting in the
applicant’s separation are an aberration in the overall length and quality
of his more than 15 years of military service. Accordingly, the Board
voted to grant full relief in the form of an upgrade of characterization of
service to fully honorable and a change to the narrative reason for
separation to Secretarial Authority. This action entails a restoration of
grade to E6 and a change to the reentry eligibility (RE) code to RE-1.
