PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The applicant’s record is void of the specific facts and circumstances concerning the events that led to his discharge from the Army. The Board noted that the applicant’s record contains a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty) which was authenticated by the applicant. This document identifies the reason and characterization of the discharge as misconduct Chapter 14, AR 635-200, with characterization of service as under other than honorable conditions. On 23 July 1996, The Department of the Army, US Army Field Artillery School and Fort Sill, Oklahoma; Orders 205-0105; discharged the applicant from the Regular Army.

         b. On 26 July 1996, the applicant was discharged. At the time of discharge, the applicant had 5 years, 4 months, and 6 days, service on his current enlistment and 16 years, 7 months, and 15 days, total time in service.

         c. The evidence of record also shows that on 16 October 1995 the applicant was reduced from staff sergeant/E6 to sergeant/E5.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l4 establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, but a general discharge under honorable conditions or an honorable discharge may be granted.

The Board noted that the applicant’s record contains a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty) which was authenticated by the applicant. This document identifies the reason and characterization of the discharge and the Board presumed government regularity in the discharge process. The Board, being convinced that the reason for discharge and the characterization of service were proper and equitable, voted to deny relief.
