      The Army Discharge Review Board reviewed your case and determined

                         PART IV - PREHEARING REVIEW

                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  Evidence of record shows that on 13 December 1994, the unit
commander notified the applicant of initiation of separation action under
the provisions of Chapter l3, AR 635-200, by reason of unsatisfactory
performance, with a general, under honorable conditions discharge.  The
commander indicated that he was initiating separation action because the
applicant failed to be at his appointed place of duty; failed to complete
assigned missions; and, failed a record APFT. He was advised of his rights.
 The applicant consulted with legal counsel, was advised of the impact of
the discharge action, and did not submit a statement in his own behalf.
The unit commander subsequently recommended separation from the service and
waiver of further rehabilitative efforts.  On 5 January 1995, the
separation authority waived further rehabilitative efforts and directed
that the applicant be released from active duty and transferred to the
Individual Ready Reserve.  His service was characterized as general, under
honorable conditions.

      b.  On 24 January 1995, the applicant was discharged.  At the time of
discharge, the applicant had completed 2 years, 4 months, and 9 days of
active military service in the period under review and had a total of 4
years, 4 months and 17 days of military service.

      c.  On 8 September 1998, the applicant was honorably discharged from
the USAR upon completion of his statutory service obligation.

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter 13 contains the policy and outlines the procedures for separating
individuals for unsatisfactory performance, to include separation for those
individuals who fail to maintain Army physical standards.  Initiation of
separation proceedings is required for individuals without medical
limitations who have two consecutive failures of the Army physical fitness
test or who are eliminated for cause from Noncommissioned Officer Education
System courses unless the responsible commander chooses to impose a bar to
reenlistment per AR 601-280.  Service of individuals separated because of
unsatisfactory performance will be characterized as honorable or under
honorable conditions as warranted by their military records.

      a.  Propriety:   The applicant has not submitted an issue of
                   propriety and the ADRB has not otherwise relied upon an
                   issue of propriety to change the discharge.

      b.  Equity:      The parenthetical number(s) below correspond(s) to
                   the issue number(s) on the DD Form 293, or in Part VI,
                   Paragraph 1, above.

        (1)  The issue is rejected.  See response to issue (2), below.

        (2)  The issue is accepted.  The Board carefully examined the
applicant’s record of service during the period of enlistment under review.
 There was a full consideration of all faithful and honorable service as
well as the incidents of unsatisfactory performance.  The evidence of
record clearly shows that a MOS/Medical Retention Board (MMRM) determined
that the limitations imposed by the applicant’s permanent profile were so
prohibitive that they precluded his retraining and reclassification into a
MOS in which the Army had a requirement.  In addition, the MMRB indicated
that his ability to satisfactorily perform the duties of his office, grade,
rank of obligation on active duty were questionable and he was referred to
the Army Disability System (MEBD and PEB) for further evaluation.  The
record also shows that the applicant did not complete a scheduled exercise
because his wife called threatening to cause bodily harm to herself.  While
the applicant was allowed to return home to settle his personal problems,
the applicant’s chain of command counseled him on his inability to control
his marriage and domestic issues and indicated that he would face UCMJ
action for any future failures to complete missions.  Given the above, it
appears that the applicant’s ability to perform satisfactorily was impaired
by his medical condition and his wife’s need for his presence.  Further,
since there is no record of nonjudicial punishment or courts-martial, he
attained the grade of specialist/E-4, and he was released to the USAR
Control Group and honorably completed his obligatory service, the Board
found that the characterization of service is now inequitable.
Accordingly, the Board voted to grant partial relief in the form of an
upgrade of characterization of service to fully honorable.  The Board found
that the reason for discharge was both proper and equitable, and voted not
to change it.
