      The Army Discharge Review Board reviewed your case and determined
that relief is warranted.  The Board has directed the ARBA Support
Division, St. Louis, MO, to take action as indicated on the enclosed OSA
Form 172, Case Report and Directive.  This document reflects the findings,
conclusions, and reasons for the Board's decision.  The official
notification of any change to your official military personnel record,
including the appropriate documentation, will be mailed to you by the ARBA
Support Division.

      If you believe that the decision in your case is unclear, not
responsive to the issues raised, or does not otherwise agree with the
decisional document requirements of DoD Directive 1332.28, you may submit a
complaint in accordance with Enclosure 5 of that directive.  You should
read Enclosure 5 of that directive before submitting a complaint.  The
complaint procedure does not permit you to challenge the merits of the
decision, but is designed solely to ensure that the decisional document
meets applicable requirements for clarity and responsiveness.  You may

      You may reapply to the Army Discharge Review Board for a personal

                         PART IV - PREHEARING REVIEW

                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  Evidence of record shows that the unit commander notified the
applicant of initiation of separation action under the provisions of
Chapter l3, AR 635-200, by reason of unsatisfactory performance, with a
general, under honorable conditions discharge.  The commander indicated
that he was initiating separation action based on the applicant’s
disobeying lawful orders, AWOL, and his unwillingness to adapt to the
requirements of Army life.  He was advised of his rights.  The applicant
consulted with legal counsel, was advised of the impact of the discharge
action, and submitted a statement in his own behalf.  The unit commander
subsequently recommended separation from the service and waiver of further
rehabilitative efforts.  The separation authority waived further
rehabilitative efforts and directed that the applicant be discharged with a
characterization of service of general, under honorable conditions.

      b.  On 31 May 2001, the applicant was discharged.  At the time of
discharge, the applicant had completed 4 years, 9 months, and 10 days of
active military service and accrued 8 days of lost time due to AWOL in the
period under review.

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter 13 contains the policy and outlines the procedures for separating
individuals for unsatisfactory performance, to include separation for those
individuals who fail to maintain Army physical standards.  Initiation of
separation proceedings is required for individuals without medical
limitations who have two consecutive failures of the Army physical fitness
test or who are eliminated for cause from Noncommissioned Officer Education
System courses unless the responsible commander chooses to impose a bar to
reenlistment per AR 601-280.  Service of individuals separated because of
unsatisfactory performance will be characterized as honorable or under
honorable conditions as warranted by their military records.

        (2)  The issue is accepted.  The Board carefully examined the
applicant’s record of service during the period of enlistment under review.
 There was a full consideration of all faithful and honorable service as
well as the instances of unsatisfactory performance.  The Board noted from
the evidence of record that at the time of separation the applicant had
completed over four years of active military service.  He attained the rank
of specialist/E-4, received two Army Achievement Medals, an Army Good
Conduct Medal, and earned his Expert Infantryman Badge.  The applicant is
now honorably serving in the Texas Army National Guard.  Notwithstanding,
the instances of unsatisfactory performance, the Board found that he had
service of sufficient length and merit to warrant a change in the discharge
being reviewed.  Accordingly, the Board voted to grant relief in the form
of an upgrade of characterization of service to fully honorable. However,
the Board found that the reason for discharge was both proper and
equitable, and voted not to change it.
