                         PART IV - PREHEARING REVIEW

                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  Evidence of record shows that on 9 July 1998, the unit commander
notified the applicant of initiation of separation action under the
provisions of Chapter l4, AR 635-200, by reason of misconduct—patterns of
misconduct, with a general, under honorable conditions discharge.  He was
advised of his rights.  The applicant consulted with legal counsel, was
advised of the impact of the discharge action, and did not submit a
statement in his own behalf.  The unit commander subsequently recommended
separation from the service and waiver of further rehabilitative efforts.
The intermediate commander reviewed the proposed discharge action and
recommended approval of the separation action with a general, under
honorable conditions discharge.  On 6 August 1998, the separation authority
waived further rehabilitative efforts and directed that the applicant be
discharged with a characterization of service of general, under honorable
conditions.

      b.  On 14 August 1998, the applicant was discharged.  At the time of
discharge, the applicant had completed 1 year, 6 months, and 10 days of
active military service in the period under review.

      c.  The applicant was fully apprised of his rights on 16 July 1998.
With his signature he affirmed the following:  “I understand that I may
expect to encounter substantial prejudice in civilian life if a general
discharge under honorable conditions is issued to me…I understand that if I
receive a discharge/character of service which is less than honorable, I
may make application to the Army Discharge Review Board or the Army Board
for Correction of Military Records for upgrading; however, I realize that
an act of consideration by either board does not imply that my discharge
will be upgraded.”  The applicant retained a copy of this signed statement.

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter l4 establishes policy and prescribes procedures for separating
members for misconduct.  Specific categories include minor disciplinary
infractions, a pattern of misconduct, commission of a serious offense, to
include abuse of illegal drugs, convictions by civil authorities and
desertion or absence without leave.  Action will be taken to separate a
member for misconduct when it is clearly established that rehabilitation is
impractical or unlikely to succeed.  Army policy states that an under other
than honorable conditions discharge is normally considered appropriate, but
a general discharge under honorable conditions or an honorable discharge
may be granted.

      a.  Propriety:   The applicant has not submitted an issue of
                   propriety and the ADRB has not otherwise relied upon an
                   issue of propriety to change the discharge.

                   Paragraph 1, above.

        (1-5)  The issues are rejected.  The Board carefully examined the
applicant’s record of service during the period of enlistment under review.
 There was a full consideration of all faithful and honorable service as
well as the infractions of discipline, the extent thereof, and the
seriousness of the offenses.  The Board noted the applicant’s contentions,
however, it found sufficient misconduct in his official record to warrant
the separation action under review.  The applicant's discharge was
appropriate because the quality of his service was not consistent with the
Army's standards for acceptable personal conduct and performance of duty by
military personnel.  The record shows that the applicant required constant
supervision on the job.  In addition, he was suspected of selling
contraband to trainees, and during a health and welfare inspection,
marijuana, drug paraphernalia, and nearly $900 were discovered.  A CID
final report of investigation established probable cause to believe that
the applicant was engaged in selling drugs to trainees.  He was also
arrested by the military police for assault and witnesses indicated that he
also discharged a firearm at another soldier during the altercation
(however, firearm was not recovered.)  The applicant provided no
independent corroborating evidence demonstrating that either the command’s
action was erroneous or that the applicant’s service mitigated the
misconduct.  Before initiating action to separate the applicant, the
command ensured the applicant was appropriately counseled about the
deficiencies that could lead to separation.  The Board noted that the
command made an assessment thereafter of the applicant's potential for
becoming a fully satisfactory soldier, and the command appropriately
determined the applicant did not demonstrate the potential for further
military service.  The Board found no evidence of arbitrary or capricious
actions by the command.  The Board was satisfied that all requirements of
law and regulation were met and the rights of the applicant were fully
protected throughout the separation process.  The US Army does not have,
nor has it ever had, a policy to automatically upgrade discharges.  Each
case is decided on its own merits when an applicant submits a DD Form 293
requesting a change in discharge.  Changes may be warranted if the Board
determines that the characterization of service or the reason for discharge
or both were improper or inequitable.  The Board, being convinced that the
reason for discharge and the characterization of service were both proper
and equitable, voted to deny relief.
