                         PART IV - PREHEARING REVIEW

                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  Evidence of record shows that on 30 January 2002, DA, HQ, 7th
Infantry Division and Fort Carson, Fort Carson, CO, Orders 030-0001
discharged the applicant from the Regular Army, effective 5 February 2002.
The record contains a properly constituted DD Form 214 (Certificate of
Release or Discharge from Active Duty) which was authenticated by the
applicant.  His DD Form 214 indicates that he was discharged under the
provisions of Chapter 5, Paragraph 5-13, AR 635-200 by reason of
personality disorder with an honorable discharge.  He was assigned a
separation code of JFX and an RE code of 3.  The specific facts and
circumstances pertaining to the applicant’s discharge are not contained in
the available records.

      b.  On 5 February 2002, the applicant was discharged.  At the time of
discharge, the applicant had completed 1 year, 1 month, and 4 days of
active military service in the period under review.

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 635-200
provides the basic authority for the separation of enlisted personnel.
Paragraph 5-13 provides that a soldier may be separated for personality
disorder, not amounting to disability under Army Regulation 635-40, that
interferes with assignment to or performance of duty.  The regulation
requires that the condition be a deeply ingrained maladaptive pattern of
behavior of long duration that interferes with the soldiers’ ability to
perform duty, and requires that the diagnosis be so severe that the
soldier’s ability to function in the military environment is significantly
impaired.  The regulation also directs that commanders will not take action
prescribed in this chapter in lieu of disciplinary action, and that
separation for personality disorder is not appropriate when separation is
warranted under chapter 4, 5, 7, 9, 10, 11, 13, 14, or 15; Army regulation
604-10 or Army Regulation 635-40.  Army policy requires the award of a
fully honorable discharge in such cases.

      a.  Propriety:   The applicant has not submitted an issue of
                   propriety and the ADRB has not otherwise relied upon an
                   issue of propriety to change the discharge.

      b.  Equity:      The parenthetical number(s) below correspond(s) to
                   the issue number(s) on the DD Form 293, or in Part VI,
                   Paragraph 1, above.

        (1)  The issue is rejected.  The Board carefully examined the
available record of service during the period of enlistment under review.
The applicant’s record is void of facts and circumstances concerning events
that led to a discharge from the Army.  The Board noted that the
applicant’s record contains a properly constituted DD Form 214 (Certificate
of Release or Discharge from Active Duty) which was authenticated by the
applicant.  This document identifies the reason and characterization of the
discharge and the Board presumed government regularity in the discharge
process.  With this type of discharge, the applicant would have been
diagnosed with a personality disorder by competent medical authority prior
to his separation from service.  Although the applicant has submitted a
current psychiatric examination indicating that he only suffers from phase
of life problems, this examination does not sufficiently refute the
approved reason for the applicant’s discharge.  The current evaluation
appears to be based only upon the applicant’s report of his medical history
obtained through an interview with the psychiatrist and does not include a
comprehensive evaluation protocol (testing, clinical evaluation, etc.)
Individuals are assigned RE codes based on their service records or the
reason for discharge.  The applicant was appropriately assigned an RE code
of 3.  This Board found no bases upon which to change the applicant’s
reason for discharge. An RE Code of 3 indicates that the applicant requires
a waiver prior to being allowed to reenlist.  If the applicant desires to
reenlist, he should contact the local recruiter to determine his
eligibility to reenlist.  Those individuals can best advise a former
service member as to the needs of the Army at the time, and are required to
process waivers of RE codes.  The Board, being convinced that the reason
for discharge was both proper and equitable, voted to deny relief.
