                         PART IV - PREHEARING REVIEW

                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  The evidence of record shows that the applicant was reported
absent without leave (AWOL), effective 14 November 2001 and returned to
military control on 5 February 2002.  On 23 February 2002 he again departed
AWOL and was subsequently dropped from the rolls (DFR) on the same day
since he again departed AWOL while pending disposition for his initial
unauthorized absence.  On 1 March 2002, he surrendered to the military
authorities at Fort Sill, Oklahoma and was transferred to the PCF at the
same location for further processing.  On 7 March 2002, the applicant was
charged with AWOL from 14 November 2001 – 5 February 2002 and from 23
February – 1 March 2002.  On 7 March 2002, the applicant consulted with
legal counsel and voluntarily requested, in writing, discharge under the
provisions of Chapter l0, AR 635-200 in lieu of trial by court-martial.  In
this request, the applicant admitted guilt to the offense, or a lesser-
included offense.  Further, the applicant indicated that he understood that
he could receive an under other than honorable conditions discharge and
that the discharge would have a significant effect on eligibility for
veteran’s benefits.  The applicant did not submit a statement in his own
behalf.  On 8 March 2002, the applicant was placed on voluntary excess
leave pending completion of his administrative discharge proceeding under
Chapter 10, AR 635-200.  On 14 March 2002, the unit commander recommended
approval of an under other than honorable conditions discharge.  On 18
March 2002, the proper legal authority reviewed the applicant’s request for
discharge and found no legal objections to further processing.  On 18 March
2002, the separation authority approved the discharge with an under other
than honorable conditions discharge and reduction to Private E1.

      b.  On 21 March 2002, the applicant was discharged.  At the time of
discharge, the applicant had completed 1 year, 4 months, and 1 day of
active military service (which included 14 days of excess leave), and
accrued 89 days of lost time in the period under review.

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter l0 of that regulation provides, in pertinent part, that a member
who has committed an offense or offenses for which the authorized
punishment includes a punitive discharge may submit a request for a
discharge for the good of the service in lieu of trial by court-martial.
The requests may be submitted at any time after charges have been preferred
and must include the individual’s admission of guilt.  Army policy states
that although an honorable or general discharge is authorized, a discharge
under other than honorable conditions is normally considered appropriate.
