                         PART IV - PREHEARING REVIEW

                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  All the facts and circumstances pertaining to the applicant’s
discharge are not contained in the available records.  The evidence of
record shows that the unit commander recommended separation of the
applicant under the provisions of Chapter l4, AR 635-200, by reason of
misconduct—commission of a serious offense-abuse of illegal drugs, with a
general, under honorable conditions discharge.  The reasons for the
proposed action was he had two separate violations of wrongfully using a
controlled substance (marijuana); violated a lawful general order; missed
formation on two occasions; and disrespect to an NCO.  The record shows
that on 2 March 1999, DA, HQ, Fort Riley, Kansas, Orders 061-0002
discharged the applicant from active duty, effective 3 March 1999.  The
record also contains a properly constituted DD form 214 (Certificate of
Release or Discharge from Active Duty), which was authenticated by the
applicant’s signature.  His DD Form 214 indicates that he was discharged
under the provisions of Chapter 14, Paragraph 14-12c(2), AR 635-200, by
reason of misconduct, with a characterization of service of general, under
honorable conditions.  Furthermore, the DD Form 214 shows a Separation Code
of JKK (i.e., misconduct), with a Reentry Code of 4.

      b.  On 3 March 1999, the applicant was discharged.  At the time of
discharge, the applicant had completed 3 years of active military service
in the period under review.

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter l4 establishes policy and prescribes procedures for separating
members for misconduct.  Specific categories include minor disciplinary
infractions, a pattern of misconduct, commission of a serious offense, to
include abuse of illegal drugs, convictions by civil authorities and
desertion or absence without leave.  Action will be taken to separate a
member for misconduct when it is clearly established that rehabilitation is
impractical or unlikely to succeed.  Army policy states that an under other
than honorable conditions discharge is normally considered appropriate, but
a general discharge under honorable conditions or an honorable discharge
may be granted.

        (2)  The issue is accepted.  The Board carefully examined the
applicant’s record of service during the period of enlistment under review.
 There was a full consideration of all faithful and honorable service as
well as the infractions of discipline, the extent thereof, and the
seriousness of the offenses.  The evidence of record shows that the
applicant was discharged on his expiration term of service date.  Army
Regulation 635-200, Chapter 3, Paragraph 3-7a(1) provides, in effect, that
only the honorable characterization of service may be awarded a soldier
upon completion of his/her period of enlistment (i.e., expiration term of
service date).  Accordingly, the Board voted to grant partial relief by
changing the characterization of service to fully honorable.  However, the
Board found sufficient evidence of misconduct to support the applicant’s
discharge by reason of misconduct.  In view of the foregoing, the Board
determined that the reason for discharge was both proper and equitable and
voted not to change it.
