PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 10 November 1994, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l4, AR 635-200, by reason of misconduct—pattern of misconduct, with a recommendation for a general, under honorable conditions discharge (GD). The applicant was advised of his rights, consulted with legal counsel, was advised of the impact of the discharge action, and elected not to submit a statement in his own behalf. The intermediate commander reviewed the proposed discharge action and recommended approval of the separation action with a GD. On 16 December 1994, the separation authority waived further rehabilitative efforts and directed that the applicant be discharged with a GD.

         b. On 22 December 1994, the applicant was discharged with a GD. At the time of discharge, the applicant had completed 1 year of his current enlistment and a total of 5 years, 10 months and 29 days of active military service.

         c. The applicant’s record shows that he completed almost over 5 and ½ years of service; attained the rank of specialist/E-4; and that he had earned a Good Conduct Medal. There are no documented acts of valor, significant achievement, or service warranting special recognition contained in the record. However, there is an extensive history of disciplinary problems recorded during the period of enlistment under review. This history includes his acceptance of two Article 15’s: the first on 14 December 1993, for disobeying a lawful order; and the second on 16 September 1994, field grade, for unlawfully striking a female soldier by punching her in the stomach which resulted in his reduction to the rank of private/E-1. The applicant’s record also includes counseling for multiple incidents of writing bad checks and for receiving a speeding ticket. The unit commander cited the disciplinary record outlined above as the basis for taking separation action to process the applicant for separation for a pattern of misconduct.

2. Legal/Regulatory Basis for Separation Action: Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l4 establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, but a general discharge under honorable conditions or an honorable discharge may be granted.

         a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

(1), (2), and (3) The issues are rejected. The Board noted the applicant’s contentions that, in effect, his record of service was honorable; that his misconduct was not duty related; and that he has been a good citizen since his separation from the Army. However, after carefully examining the applicant’s record of service for the period of enlistment under review, the Board concluded that the applicant's discharge was appropriate. The applicant’s quality of service was not consistent with the Army's standards for acceptable personal conduct and performance of duty by military personnel. The applicant provided no independent corroborating evidence demonstrating that either the command's action was erroneous or that his service mitigated his misconduct. Finally, while the Board commends the applicant for his excellent post service conduct, this does not provide a sufficient basis for granting relief. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
