SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:
a. Evidence of record shows that on 23 March 1998, the applicant was
a self-referral to the ADAPCP. On 19 May 1998, he was administered a
urinalysis as part of a 100% unit level urinalysis. On 28 May 1998, the
unit commander was notified that the applicant’s urine sample tested
positive for cocaine. On 28 May 1998, the unit commander in consultation
with the Clinical Director, Community Counseling Center declared the
applicant a rehabilitation failure. On 11 June 1998, the unit commander
notified the applicant of initiation of separation action under the
provisions of Chapter 9, AR 635-200, by reason of drug rehabilitation
failure, with a general, under honorable conditions discharge. He was
advised of his rights. On 11 June 1998, the applicant consulted with legal
counsel, was advised of the impact of the discharge action, and did not
submit a statement in his own behalf. He was also entitled to have his
case considered by an administration separation board; however, he
voluntarily waived a board contingent upon receiving a characterization of
service no less than a general, under honorable conditions. On 23 June
1998, the unit commander subsequently recommended separation from the
service. The intermediate commander reviewed the separation action and
recommended approval with a general discharge. On 25 June 1998, the
separation authority directed that the applicant be discharged with a
characterization of service of general, under honorable conditions.
b. On 30 June 1998, the applicant was discharged. At the time of
discharge, the applicant had completed 11 months and 22 days of active
military service in the period under review and had a total of 8 years, 6
months, and 19 days of total military service.
2. Legal/Regulatory Basis for Separation Action: Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter 9 contains the authority and outlines the procedures for
discharging individuals because of alcohol or other drug abuse. A member
who has been referred to the Alcohol and Drug Abuse Prevention and Control
Program (ADAPCP) for alcohol/drug abuse may be separated because of
inability or refusal to participate in, cooperate in, or successfully
complete such a program if there is a lack of potential for continued Army
service and rehabilitation efforts are no longer practical. Army policy
states that an honorable or general discharge is authorized depending on
the applicant’s overall record of service. (However, an honorable
discharge is required if restricted use information is used in the
discharge process).

(2) The issue is accepted. The Board noted that the government
introduced a document into the discharge process revealing that the
applicant had self-referred to the Alcohol and Drug Prevention and Control
Program for substance abuse. This is limited use information as defined in
Chapter 6, AR 600-85. Use of this information mandates award of a fully
honorable discharge. Accordingly, the Board voted grant partial relief and
to change the characterization of service to fully honorable. However, the
board found that the reason for discharge was fully supported by the record
and voted not to change it.

(1) The issue is rejected. Eligibility for veteran's benefits to
include educational benefits under the Montgomery GI Bill does not fall
