PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

          a. The evidence of record shows that on 3 February 1998, the unit commander in consultation with the Clinical Director/ADAPCP declared the applicant rehabilitation failure. The Staff Judge Advocate determined the separation action to be legally sufficient. On 26 May 1998, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter 9, AR 635-200 and reason of alcohol abuse rehabilitation failure, with a general discharge. He was advised of his rights. The applicant acknowledged notification, was advised of the impact of the discharge action. The unit commander subsequently recommended approval of the discharge action and forwarded it through command channels to the separation authority. On 11 June 1998, the separation authority waived further rehabilitative efforts and directed that the applicant be discharged with a general discharge.

         b. On 10 August 1998, the applicant was discharged with a general, under honorable conditions discharge, under the provisions of Chapter 9, AR 635-200, by reason of alcohol rehabilitation failure. He was credited with 2 years,
6 months, and 24 days active service on the enlistment under review.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 9 contains the authority and outlines the procedures for discharging individuals because of alcohol or other drug abuse. A member who has been referred to the Alcohol and Drug Abuse Prevention and Control Program (ADAPCP) for alcohol/drug abuse may be separated because of inability or refusal to participate in, cooperate in, or successfully complete such a program if there is a lack of potential for continued Army service and rehabilitation efforts are no longer practical. Army policy states that an honorable or general discharge is authorized depending on the applicant’s overall record of service. (However, an honorable discharge is required if restricted use information is used in the discharge process).

          a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

 (1) The issue is rejected. The Board carefully reviewed the applicant’s record of service during the period of enlistment under review. The evidence of record shows that the command attempted to assist the applicant in performing and conducting himself to Army standards by providing alcohol and drug counseling and by the imposition of nonjudicial punishment. The applicant failed to respond appropriately to these efforts. By abusing alcohol and illegal drugs, the applicant knowingly risked a military career and diminished the quality of service below that meriting a fully honorable discharge. The Board cannot change the applicant’s reentry eligibility (also known as the reenlistment) (RE) code. To obtain a change in an RE code, the applicant should provide supporting documentation to justify any change and submit the request to the Commander, US Army PERSCOM, ATTN: TAPC-EPR-P, 2461 Eisenhower Avenue, Alexandria, Virginia 22331-0450. To obtain a waiver for reenlistment, the applicant should contact a local Army recruiter for assistance. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
