                         PART IV - PREHEARING REVIEW

                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  The specific facts and circumstances leading to the applicant’s
discharge are not contained in the available records.  Evidence of record
shows that on 26 September 2000, the applicant enlisted in the United
States Army Reserve.  On 10 February 2003, he was ordered to active duty in
support of Operation Enduring Freedom/Iraqi Freedom in Kuwait and Iraq.  On
29 December 2003, the separation authority directed that the applicant be
separated from the Army prior to the expiration of his current term of
service, with a characterization of service of general, under honorable
conditions.  Evidence of record also shows that on 6 January 2004, Orders
036-005, DA, HQ, US Army Fort Dix, Fort Dix, NJ, discharged the applicant
from active duty, effective 6 January 2004.  The record contains a properly
constituted DD form 214 (Certificate of Release or Discharge from Active
Duty), which was authenticated by the applicant’s signature.  His DD Form
214 indicates that he was discharged under the provisions of Chapter 14,
paragraph 14-12c, AR 635-200, by reason of misconduct, with a
characterization of service of general, under honorable conditions.
Furthermore, the DD Form 214 shows a Separation Code of JKQ (i.e.,
misconduct), with a Reentry Code of 3.

      b.  On 6 January 2004, the applicant was discharged.  At the time of
discharge, the applicant had completed 10 months and 27 days of active
military service in the period under review and had a total of 3 years, 3
months, and 13 days of total military service.

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter l4 establishes policy and prescribes procedures for separating
members for misconduct.  Specific categories include minor disciplinary
infractions, a pattern of misconduct, commission of a serious offense, to
include abuse of illegal drugs, convictions by civil authorities and
desertion or absence without leave.  Action will be taken to separate a
member for misconduct when it is clearly established that rehabilitation is
impractical or unlikely to succeed.  Army policy states that an under other
than honorable conditions discharge is normally considered appropriate, but
a general discharge under honorable conditions or an honorable discharge
may be granted.

        (2)  The issue is accepted.  The Board carefully examined the
applicant’s record of service during the period of enlistment under review
and heard his testimony.  The Board does not condone the applicant’s
misconduct; however, determined that the discharge is inequitable.  The
Board found that the extenuating circumstances surrounding the applicant’s
discharge process mitigated the discrediting entry in the service record.
In view of the foregoing, the Board voted to grant relief in the form of an
upgrade of the characterization of service to fully honorable and a change
to the narrative reason for separation to Secretarial Authority.  This
action does not entail a change to the reentry eligibility (RE) code.
