                         PART IV - PREHEARING REVIEW

                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  Evidence of record shows that on 1 December 2003, the unit
commander notified the applicant of initiation of separation action under
the provisions of Chapter l1, AR 635-200, by reason of entry level
performance and conduct, with uncharacterized service.  The reason for the
proposed actions was her lack of ability to complete basic combat training
due to her physical limitations.  She was advised of her rights.  The
applicant waived her right to consult with legal counsel, was advised of
the impact of the discharge action, and did not submit a statement in his
own behalf.  The unit commander subsequently recommended separation from
the service and waiver of further rehabilitative efforts.  On 1 December
2003, the separation authority waived further rehabilitative efforts and
directed that the applicant be separated with a characterization of service
of uncharacterized.

      b.  On 9 December 2003, the applicant was discharged.  At the time of
discharge, the applicant had completed 6 months and 5 days of active
military service in the period under review.

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter 11, of this regulation, in effect at the time, provided, for the
separation of personnel due to unsatisfactory performance, conduct, or
both, while in an entry level status.  This provision of regulation applied
to individuals who had demonstrated that they were not qualified for
retention because they could not adapt socially or emotionally to military
life, or because they lacked the aptitude, ability, motivation or self
discipline for military service, or that they had demonstrated
characteristics not compatible with satisfactory continued service.  The
separation policy applies to soldiers who cannot meet the minimum standards
prescribed for successful completion of training because of lack of
aptitude, ability, motivation or self-discipline.  The regulation requires
uncharacterized service for separation under this chapter.

        (2)  The issue is accepted.  The Board carefully examined the
applicant’s record of service during the period of enlistment under review.
 The evidence of record shows that the applicant’s discharge under the
provisions of Chapter 11, AR 635-200, by reason of entry-level performance
and conduct was initiated and approved on the 180th day of the applicant’s
active duty service.  Notwithstanding the propriety of the discharge
process, the Board determined that the discharge was inequitable.  The
Board found that through no fault of her own the applicant’s ability to
serve was impaired by an injury incurred in service.  In view of the
foregoing, the Board voted to grant full relief in the form of an upgrade
of characterization of service to fully honorable and a change to the
narrative reason for separation to Secretarial Authority.  This action does
not entail a change in RE code.
