                         PART IV - PREHEARING REVIEW

                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  The evidence of record shows that the applicant departed in AWOL
status on 5 October 2000.  At the time of his departure, he had completed 6
months and 5 days.  He was dropped from the rolls as a deserter on 4
November 2000.  On 20 November 2000, the applicant surrendered to military
authorities at Fort Bragg, NC, and was transferred to the Special
Processing Company, Personnel Control Facility, at Fort Knox, KY.  On 22
November 2000, the applicant was charged with AWOL (001005-001118).  On 22
November 2000, the applicant consulted with legal counsel and voluntarily
requested, in writing, discharge under the provisions of Chapter l0, AR 635-
200 in lieu of trial by court-martial.  In this request, the applicant
admitted guilt to the offense, or a lesser included offense.  Further, the
applicant indicated that he understood that he could receive an under other
than honorable conditions discharge and that the discharge would have a
significant effect on eligibility for veteran’s benefits.  The applicant
did not submit a statement in his own behalf.  The unit commander
recommended approval of an under other than honorable conditions discharge.
 On 23 November 2000, the applicant was placed on involuntary excess leave
pending approval of his discharge.  On 4 December 2001, the separation
authority approved the discharge with an under other than honorable
conditions discharge.  The applicant was to be reduced to the lowest
enlisted rank.

      b.  On 7 January 2002, the applicant was discharged.  At the time of
discharge, the applicant had completed 1 year, 7 months, and 24 days of
active military service (to include 411 days of excess leave) and accrued
45 days of lost time due to AWOL in the period under review.

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter l0 of that regulation provides, in pertinent part, that a member
who has committed an offense or offenses for which the authorized
punishment includes a punitive discharge may submit a request for a
discharge for the good of the service in lieu of trial by court-martial.
The requests may be submitted at any time after charges have been preferred
and must include the individual’s admission of guilt.  Army policy states
that although an honorable or general discharge is authorized, a discharge
UOHC is normally considered appropriate.

        (2)  The issue is accepted.  The Board carefully examined the
applicant’s record of service during the period of enlistment under review.
 There was a full consideration of all faithful and honorable service as
well as the infraction of discipline, the extent thereof, and the
seriousness of the offense.  The Board found, based on credible mitigating
evidence provided by the applicant, that the discharge was/is inequitable.
In addition, the Board found that the applicant submitted evidence of
favorable post-service conduct.  Accordingly, the Board voted to grant
relief in the form of an upgrade of characterization of service to fully
honorable and to change the narrative reason for discharge to Secretarial
Authority.  This action entails a change in RE code to 1.
