                         PART IV - PREHEARING REVIEW

                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  Evidence of record shows that on 18 November 1993, DA, HQ, 101st
Airborne Division (Air Assault) and Fort Campbell, Fort Campbell, KY,
discharged the applicant from the Regular Army, effective 22 November 1993.
 The record contains a properly constituted DD Form 214 (Certificate of
Release or Discharge from Active Duty) which was authenticated by the
applicant.  Her DD Form 214 indicates that she was discharged under the
provisions of Chapter 14, AR 635-200 by reason of misconduct-pattern of
misconduct, with a characterization of service of under other than
honorable conditions.  The specific facts and circumstances pertaining to
the applicant’s discharge are not contained in the available records.

      b.  On 22 November 1993, the applicant was discharged.  At the time
of discharge, the applicant had completed 1 year, 1 month, and 23 days of
active military service in the period under review.

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter l4 establishes policy and prescribes procedures for separating
members for misconduct.  Specific categories include minor disciplinary
infractions, a pattern of misconduct, commission of a serious offense, to
include abuse of illegal drugs, convictions by civil authorities and
desertion or absence without leave.  Action will be taken to separate a
member for misconduct when it is clearly established that rehabilitation is
impractical or unlikely to succeed.  Army policy states that an under other
than honorable conditions discharge is normally considered appropriate, but
a general discharge under honorable conditions or an honorable discharge
may be granted.

        (2)  The issue is accepted.  The Board carefully examined the
available record of service during the period of enlistment under review.
Although all the facts and circumstances leading to the applicant’s
discharge were not available for review, the Board determined, based on the
type of discharge the applicant received and her written statement
explaining the nature of her misconduct, that the characterization of
service was inequitable.   Accordingly, the Board voted to grant relief in
the form of an upgrade of characterization of service to general, under
honorable conditions.  The Board determined that the reason for discharge
was both proper and equitable and voted not to change it.
