PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 10 June 1994, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l4, AR 635-200, by reason of misconduct—pattern of misconduct, with a general, under honorable conditions discharge (GD). The applicant was advised of his rights, consulted with legal counsel, was advised of the impact of the discharge action, waived a hearing by a board of officers, and elected not to submit a statement in his own behalf. The unit commander subsequently recommended separation with a GD. The intermediate commander reviewed the proposed discharge action and recommended approval of the separation action. The Staff Judge Advocate determined that the separation action was legally sufficient. The separation authority directed that the applicant be discharged with a GD.

         b. On 18 July 1994, the applicant was discharged with a GD. At the time of discharge, the applicant had completed 4 years, 10 months, and 13 days of active military service.

         c. The applicant’s record shows that he completed almost 5 years of service on a 6 year enlistment; that the highest rank he attained while on active duty was specialist/E-4; and that he earned an Army Commendation Medal and a Good Conduct Medal. There is an extensive disciplinary history which includes his acceptance of two Article `15’s: the first on 22 November 1993 for failing to go to his prescribed place of duty which resulted in his reduction in rank to private/E-3; and the second on 14 April 1994 for wrongfully possessing marijuana which resulted in his reduction to private/E-2. The record also contains evidence of several counseling statements for a myriad of infractions. The unit commander processed the applicant for separation for both commission of a serious offense based on his illegal drug use, and for a pattern of misconduct based on several disciplinary infractions.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l4 establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, but a general discharge under honorable conditions or an honorable discharge may be granted.

          a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.
         b. Equity:       The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above.

 (1) and (2) The issues are rejected. The Board noted the applicant’s contentions, as outlined in the letter accompanying his application, that, in effect, he desires an upgrade to his discharge to improve his post service opportunities; and that he completed 4 years of honorable service and would like to obtain education benefits to attend college and eligibility to join the National Guard or Army Reserve. However, the Board concluded these factors do not mitigate the applicant’s misconduct and provide no basis upon which to grant relief. Eligibility for veteran's benefits, to include educational benefits under the Montgomery GI Bill, does not fall within the purview of the Army Discharge Review Board. Accordingly, the applicant should contact a local office of the Department of Veterans Affairs for further assistance on education benefits; in addition, the Board does not determine enlistment eligibility. If the applicant desires to enlist in a Reserve Component of the Army he should contact the local recruiter to determine his eligibility to reenlist. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
