                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  Evidence of record shows that on 3 June 2003, DA, HQ, 101st
Airborne Division (Air Assault) and Fort Campbell, Fort Campbell, KY,
Orders 154-0002 discharged the applicant from the Regular Army, effective
11 June 2003.  The record contains a properly constituted DD Form 214
(Certificate of Release or Discharge from Active Duty) which was
authenticated by the applicant.  His DD Form 214 indicates that he was
discharged under the provisions of Chapter 14, AR 635-200 by reason of
misconduct-commission of a serious offense, illegal use of drugs, with a
characterization of service of general, under honorable conditions.  The
specific facts and circumstances pertaining to the applicant’s discharge
are not contained in the available records.

      b.  On 11 June 2003, the applicant was discharged.  At the time of
discharge, the applicant had completed 9 months and 9 days of active
military service in the period under review.

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter l4 establishes policy and prescribes procedures for separating
members for misconduct.  Specific categories include minor disciplinary
infractions, a pattern of misconduct, commission of a serious offense, to
include abuse of illegal drugs, convictions by civil authorities and
desertion or absence without leave.  Action will be taken to separate a
member for misconduct when it is clearly established that rehabilitation is
impractical or unlikely to succeed.  Army policy states that an under other
than honorable conditions discharge is normally considered appropriate, but
a general discharge under honorable conditions or an honorable discharge
may be granted.

        (1)  The issues is rejected.  The applicant’s record is void of
facts and circumstances concerning events that led to a discharge from the
Army.  The Board noted that the applicant’s record contains a properly
constituted DD Form 214 (Certificate of Release or Discharge from Active
Duty) which was authenticated by the applicant.  This document identifies
the reason and characterization of the discharge and the Board presumed
government regularity in the discharge process.  The Board noted the
applicant’s contention; however, in the absence of pertinent evidence, the
Board was unable to make a determination of the seriousness of his offense
or whether the discrediting entry he referred to was mitigated by prior or
subsequent service of sufficient merit to warrant an upgrade of his
discharge.  The Board, being convinced that the reason for discharge and
the characterization of service were proper and equitable, voted to deny
relief.
