PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The available evidence of record shows that on 17 April 2001, board of officers met, applicant appeared with counsel. The board recommended separation with a characterization of service of under other than honorable conditions. On 14 May 2001, the separation authority approved the board’s recommendation and directed that the applicant be discharged with a characterization of service of under other than honorable conditions. Notwithstanding the aforementioned, the applicant was issued a DD Form 214 (Certificate of Release or Discharge from Active Duty) which indicates that he was discharged under the provisions of Chapter 14, AR 635-200 by reason of misconduct, with a characterization of service of general, under honorable conditions.

         b. On 8 July 2002, the applicant was discharged. At the time of discharge, the applicant had completed 6 years, 8 months, and 19 days of active military service and accrued 10 days of lost time in the period under review and had a total of 20 years, 1 month and 3 days of active military service.

Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l4 establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, but a general discharge under honorable conditions or an honorable discharge may be granted.

(1) The issue is rejected. The Board carefully examined the available record of service for the period of enlistment under review. There was a full consideration of all faithful and honorable service as well as the infractions of discipline, the extent thereof, and the seriousness of the offenses. The Board determined that the applicant's discharge, as approved by the convening authority, was appropriate because the quality of his service was not consistent with the Army's standards for acceptable personal conduct and performance of duty by military personnel. The evidence of record supports that the applicant, by his misconduct and poor duty performance, diminished the quality of his service below that meriting a fully honorable or general discharge. The applicant was incorrectly issued a DD Form 214, which indicates a characterization of service of general, under honorable conditions; however, it is the policy of the Board not to correct such errors when said correction would downgrade the discharge document currently held by the applicant. The Board was satisfied that all requirements of law and regulation were met and the rights of the applicant were fully protected throughout the separation process. The Board, being convinced that the approved reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
