SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:
a. The evidence of record shows that on 23 May 1994, the applicant
was charged with AWOL from 22 February – 18 May 1994. On 23 May 1994, the
applicant consulted with legal counsel and voluntarily requested, in
writing, discharge under the provisions of Chapter l0, AR 635-200 in lieu
of trial by court-martial. In this request, the applicant admitted guilt
to the offense, or a lesser included offense. Further, the applicant
indicated that he understood that he could receive an under other than
honorable conditions discharge and that the discharge would have a
significant effect on eligibility for veteran’s benefits. The applicant
submitted a statement in his own behalf. The applicant also requested to
be placed on indefinite excess leave pending completion of his
administrative discharge proceeding under Chapter 10, AR 635-200. His
request was approved and he was placed on excess leave status, effective 24
May 1994. On 5 July 1994, the unit commander recommended approval of an
under other than honorable conditions discharge. The intermediate
commander concurred and recommend an under other than honorable conditions
discharge. On 8 August 1994, the separation authority approved the
discharge with an under other than honorable conditions discharge and
reduction to the lowest enlisted grade.
b. On 14 September 1994, the applicant was discharged. At the time
of discharge, the applicant had completed 1 year, 3 months, and 17 days of
active military service (which included 114 days of excess leave), and
accrued 85 days of lost time in the period under review. The applicant had
a total of 2 years, 8 months, and 20 days of total military service.
2. Legal/Regulatory Basis for Separation Action: Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter l0 of that regulation provides, in pertinent part, that a member
who has committed an offense or offenses for which the authorized
punishment includes a punitive discharge may submit a request for a
discharge for the good of the service in lieu of trial by court-martial.
The requests may be submitted at any time after charges have been preferred
and must include the individual’s admission of guilt. Army policy states
that although an honorable or general discharge is authorized, a discharge
under other than honorable conditions is normally considered appropriate.

(1) The issue is rejected. The Board carefully examined the
applicant’s record of service during the period of enlistment under review.
There was a full consideration of all faithful and honorable service as
well as the infraction of discipline, the extent thereof, and the
seriousness of the offense. The Board noted the applicant’s contentions
and determined that the applicant had many legitimate avenues through which
to obtain assistance or relief, without committing the misconduct, which
led to the separation action under review. The evidence of record shows
the applicant was charged with the commission of offenses punishable under
the Uniform Code of Military Justice (UCMJ) with a punitive discharge. The
Board noted, after consulting with defense counsel, the applicant
voluntarily, and in writing, requested separation from the Army in lieu of
trial by general court-martial. In doing so, the applicant admitted guilt
to the stipulated or lesser-included offenses under the UCMJ. The Board
was satisfied that all requirements of law and regulation were met and the
rights of the applicant were fully protected throughout the separation
process. It also noted that the characterization of service for this type
of discharge is normally under other than honorable conditions and that the
applicant was aware of that prior to requesting discharge. The Board,
being convinced that the reason for discharge and the characterization of
service were both proper and equitable, voted to deny relief.
