PART IV - PREHEARING REVIEW
SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:
a. All the specific facts and circumstances leading to the
applicant’s discharge proceedings are not in the available records.
Evidence of record shows that on 6 March 2003, the GOSCA initiated
elimination action on the applicant under the provisions of Chapter 4,
Paragraphs 4-2a(14), 4-2b(5), 4-2c(3)(4) and (5), AR 600-8-24, by reason of
misconduct, substandard performance, and derogatory information in his
OMPF, with a characterization of service of general, under honorable
conditions. On 2 April 2003, the applicant submitted a rebuttal in
response to the aforementioned elimination action. On 9 May 2003, having
reviewed the applicant’s rebuttal statement, the GOSCA forwarded the
applicant’s elimination packet to the Commander, US Total Army Personnel
Command. The Army Board of Review for Eliminations recommended that the
applicant be eliminated from the Army and issued a general discharge. On 3
July 2003, the Deputy Assistant Secretary (Army Review Boards) approved the
elimination board’s recommendation and directed that the applicant be
discharged with a characterization of service of general, under honorable
conditions. Further, the record contains a properly constituted DD Form
214 (Certificate of Release or Discharge from Active Duty), which was
authenticated by the applicant’s signature. His DD Form 214 indicates that
he was discharged under the provisions of Chapter 4, Paragraph 4-2b, AR 600-
8-24 by reason of unacceptable conduct, with a general, under honorable
conditions discharge.
b. On 7 August 2003, the applicant was discharged. At the time of
discharge, the applicant had completed 2 years, 10 months, and 22 days of
active military service in the period under review and had a total of 5
years and 24 days of total military service.
2. Legal/Regulatory Basis for Separation Action: Army Regulation 600-8-24
sets forth the basic authority for Officer transfers and discharges.
Chapter 4 outlines the policy and procedure for eliminating officers in the
Active Army for substandard performance of duty, misconduct, moral or
professional dereliction, and the interest of national security.

(1) and (2) The issues are rejected. The Board carefully examined
the available records for the period of service under review. The Board
noted the applicant’s contentions; however, did not find said contentions
sufficiently mitigating to warrant an upgrade of the discharge under
review. The Board determined that the applicant's discharge was
appropriate because the quality of his service was not consistent with the
Army's standards for acceptable personal conduct and performance of duty by
military personnel. By his misconduct and poor duty performance, the
applicant diminished the quality of his service below that meriting a fully
honorable discharge. The applicant provided no independent corroborating
evidence demonstrating that either the command's action was erroneous or
that the applicant’s service mitigated the misconduct or poor duty
performance. The Board, being convinced that the reason for discharge and
the characterization of service were both proper and equitable, voted to
deny relief.
