PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The evidence of record shows that on 25 March 1999, Major General, USA, commanding, DA, HQ, Fort Stewart, GA, notified the applicant of initiation of elimination from Active duty under the provisions of Chapter 4, Paragraph 4-2b(5) and (8), AR 600-8-24 by reason of misconduct, moral or professional dereliction and recommended separation with a general, under honorable conditions discharge. He was advised of his rights. The applicant and his counsel submitted rebuttals to this elimination action. On 5 May 1999, Major General, USA, commanding, DA, HQ, Fort Stewart, GA, recommended approval of elimination from service with a general, under honorable conditions. On 18 June 1999, Ad Hoc review board recommended approval with issuance of a general discharge. On 21 June 1999, the Deputy Assistant Secretary (Army Review Boards) approved the recommendation of the chain of command and Hoc Review Board and directed that the applicant be discharged with a general, under honorable conditions discharge.

         b. On 30 July 1999, the applicant was discharged. He was credited with
2 years, 9 months, and 13 days active service during the period under review.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 600-8-24 sets for the basic authority for Officer transfers and discharges. Chapter 4 outlines the policy and procedure for the eliminating officer from the active Army for substandard performance of duty, misconduct, moral or professional dereliction, and the interest of national security.
