                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  Evidence of record shows that on 28 June 1995, DA, HQ, U.S. Army
Signal Center and Fort Gordon, Fort Gordon, GA, Orders 179-0900 discharged
the applicant from the Regular Army, effective 29 June 1995.  The record
contains a properly constituted DD Form 214 (Certificate of Release or
Discharge from Active Duty).  His DD Form 214 indicates that he was
discharged under the provisions of Chapter 10, AR 635-200 by reason of for
the good of the service-in lieu of trial by court-martial, with a
characterization of service of under other than honorable conditions.  The
specific facts and circumstances pertaining to the applicant’s discharge
are not contained in the available records.

      b.  On 29 June 1995, the applicant was discharged.  At the time of
discharge, the applicant had completed 4 years, 1 month, and 19 days of
active military service and accrued 15 days of lost time in the period
under review and had a total of 17 years and 7 months of total military
service.

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter l0 of that regulation provides, in pertinent part, that a member
who has committed an offense or offenses for which the authorized
punishment includes a punitive discharge may submit a request for a
discharge for the good of the service in lieu of trial by court-martial.
The requests may be submitted at any time after charges have been preferred
and must include the individual’s admission of guilt.  Army policy states
that although an honorable or general discharge is authorized, a discharge
UOHC is normally considered appropriate.

        (5)  The issue is accepted.  The Board carefully examined the
applicant’s record of service during the period of enlistment under review.
 There was a full consideration of all faithful and honorable service as
well as the infractions of discipline, the extent thereof, and the
seriousness of the offenses.  The Board found that the length and quality
of the applicant’s service mitigated his misconduct.  In view of the
foregoing, the Board determined that the characterization of service was
inequitable.  Accordingly, the Board voted to grant partial relief in the
form of an upgrade of characterization of service to general, under
honorable conditions.  The Board determined that the reason for discharge
was proper and equitable and voted not to change it.

        (1-4)  The issues are rejected.  The Board noted the applicant’s
contentions; however, changes to the DD Form 214 do not fall within the
purview of this Board and must be addressed to the Army Board for
Correction of Military Records (ABCMR).  Since the applicant has submitted
a DD Form 149 (application to the ABCMR), his official record will be
forwarded to that Board for further action.
