                         PART IV - PREHEARING REVIEW

                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  Evidence of record shows that on 14 July 2002, the unit commander
notified the applicant of initiation of separation action under the
provisions of Chapter l4, Paragraph 14-5, AR 635-200, by reason of civil
conviction, with an under other than honorable conditions discharge.  He
was advised of his rights.  The applicant consulted with legal counsel, was
advised of the impact of the discharge action, waived an appearance before
an administrative separation board contingent upon receiving a general,
under honorable conditions discharge, and did not submit a statement in his
own behalf.  The unit commander subsequently recommended separation from
the service and waiver of further rehabilitative efforts.  The intermediate
commander(s) reviewed the proposed discharge action and recommended
approval of the separation action with a general, under honorable
conditions discharge.  On 18 July 2002, the separation authority waived
further rehabilitative efforts and directed that the applicant be
discharged with a characterization of service of general, under honorable
conditions.

      b.  On 26 July 2002, the applicant was discharged.  At the time of
discharge, the applicant had completed 3 years, 9 months, and 9 days of
active military service in the period under review and had a total of 8
years, 7 months and
3 days of active military service.

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter l4 establishes policy and prescribes procedures for separating
members for misconduct.  Specific categories include minor disciplinary
infractions, a pattern of misconduct, commission of a serious offense, to
include abuse of illegal drugs, convictions by civil authorities and
desertion or absence without leave.  Action will be taken to separate a
member for misconduct when it is clearly established that rehabilitation is
impractical or unlikely to succeed.  Army policy states that an under other
than honorable conditions discharge is normally considered appropriate, but
a general discharge under honorable conditions or an honorable discharge
may be granted.

      a.  Propriety:   The applicant has not submitted an issue of
                   propriety and the ADRB has not otherwise relied upon an
                   issue of propriety to change the discharge.

                   Paragraph 1, above.

        (1)  The issue is rejected.  The Board carefully examined the
applicant’s record of service during the period of enlistment under review.
 There was a full consideration of all faithful and honorable service as
well as the infractions of discipline, the extent thereof, and the
seriousness of the offenses.  The Board noted the applicant’s contention;
however, the evidence the applicant submitted to the Board for review does
not sustain the applicant’s contention that the charges of spousal abuse
were dismissed against him.  The documentation from the court shows that
the applicant’s motion for withdrawal of his guilty plea was granted and
his findings of guilt, the resulting judgment and sentence were vacated and
set aside, and the matter was set for future trial.  The court’s decision
did not dismiss the charges against the applicant.  The applicant's
discharge was appropriate because the quality of his service was not
consistent with the Army's standards for acceptable personal conduct.  The
applicant provided no independent corroborating evidence demonstrating that
either the command's action was erroneous or that the applicant’s service
mitigated the misconduct. The Board, being convinced that the reason of
discharge and the characterization of service were both proper and
equitable, voted to deny relief.
