PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a.
The evidence of record shows that on 30 October 1990, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l3, AR 635-200, by reason of unsatisfactory performance, with an honorable discharge. He was advised of his rights. The applicant consulted with legal counsel, was advised of the impact of the discharge action, and did not submit a statement in his own behalf. The unit commander subsequently recommended separation from the service and waiver of further rehabilitative efforts. On 6 November 1990, the separation authority directed that the applicant be discharged with a characterization of honorable.

         b. On 15 November 1990, the applicant was discharged. At the time of discharge, the applicant had completed 2 years, 6 months, and 19 days of active military service.

Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 13 contains the policy and outlines the procedures for separating individuals for unsatisfactory performance, and provides, in pertinent part, that commanders will separate a member under this chapter when, in the commander's judgment, the member will not develop sufficiently to participate satisfactorily in further training and/or become a satisfactory soldier. Army policy states that a general discharge, under honorable conditions is normally considered appropriate, but an honorable discharge may be granted in meritorious cases.

         a. Propriety:    The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above.

(1) The issue is rejected. The Board carefully examined the applicant’s record of service during the period of enlistment under review. There was a full consideration of all faithful and honorable service as well as the incidents of unsatisfactory performance, the extent thereof, and the seriousness of said unsatisfactory performance. The evidence of record does not support the applicant’s contentions that he was improperly processed for discharge by reason of unsatisfactory performance. Further, the applicant has provided no independent corroborating evidence in support of his contentions. The evidence of record shows that command attempted to assist the applicant in performing and conducting himself to Army standards by providing counseling and by the imposition of nonjudicial punishment. The evidence of record established that the applicant was afforded a reasonable opportunity to overcome his deficiencies. As the applicant did not subsequently conform to required standards of discipline and performance, the command appropriately determined that he did not demonstrate the potential for further military service. The applicant was properly notified of commands intent to initiate his discharge under the provisions of Chapter 13, AR 635-200, by reason of unsatisfactory performance. The applicant was advised of his rights and after consulting with legal counsel completed his election of rights statement. Finally, changing of reentry eligibility (RE) codes does not fall within the purview of this Board. If the applicant desires to reenlist, he should contact his local recruiter to determine his eligibility to reenlist. Those individuals can best advise a former service member as to the needs of the Army at the time, and are required to process waivers of RE codes. The Board, being convinced that the reason for discharge (i.e., separation code) and the characterization of service were both proper and equitable, voted to deny relief.

         b. Equity:       The applicant has not submitted an issue of equity and the ADRB has not otherwise relied upon an issue of equity to change the discharge. The major factors upon which the discharge was based are set forth in Parts III and IV of this decisional document.
