PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 2 June 2000, DA, HQ, U.S. Infantry Center, Fort Benning, GA, Orders 154-2211 released the applicant from active duty and reassigned him to the USAR Control Group, effective 6 June 2000. The record contains a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty) which was authenticated by the applicant. His DD Form 214 indicates that he was discharged under the provisions of Chapter 4, AR 600-8-24 by reason of miscellaneous/general reasons, with a characterization of service of honorable. The specific facts and circumstances pertaining to the applicant’s discharge are not contained in the available records.

         b. On 6 January 2000, the applicant was discharged. At the time of discharge, the applicant had completed 1 year and 7 days of active military service in the period under review and had a total of 4 years, 3 months and
12 days of active military service.

         c. The applicant submitted a copy of a 3 April 2000 request for resignation from the Infantry Officer Basic Course. This document shows that the applicant requested immediate involuntary release from active duty under the provisions of Paragraph 2-27a(4) to attend law school.

Legal/Regulatory Basis for Separation Action : Army regulation 600-8-24 prescribes the policies and procedures governing the transfer and discharge of Army officer personnel. Chapter 4, prescribes the tasks and rules for eliminating officers fir substandard performance of duty, misconduct, moral or professional dereliction, and in the interests of national security.

(1) The issue is rejected. The applicant’s record is void of facts and circumstances concerning events that led to his release from the active duty. The Board noted that the applicant’s record contains a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty) which was authenticated by the applicant. This document identifies the reason and characterization of the release and the Board presumed government regularity in the processing of the applicant’s release from active duty. The Board noted the applicant’s contentions; however, there is insufficient documentation available upon which to determine whether a change in the release authority is warranted. In the absence of evidence to the contrary, the Board, is convinced that the reason for release from active duty was both proper and equitable, and voted to deny relief.
