PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 30 August 1999, the applicant was notified that after a comprehensive review of his review of his Official Military Personnel File, the CY99 Sergeant First Class/ANCOC Promotion/Selection QMP Board determined that he was to be barred from reenlistment. On 8 October 1999, DA, HQ, U.S. Infantry Center, Fort Benning, GA, Orders 281-2201 discharged the applicant from the Regular Army, effective 15 December 1999. The record contains a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty) which was authenticated with the applicant’s signature. His DD Form 214 indicates that he was discharged under the provisions of Chapter 16-8, AR 635-200 by reason of reduction in force with an honorable characterization of service. Further facts and circumstances pertaining to the applicant’s discharge are not contained in the available records.

         b. On 15 December 1999, the applicant was discharged. At the time of discharge, the applicant had completed 3 years, 5 months, and 16 days of active military service in the period under review and had a total of 10 years,
3 months and 11 days of active military service.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 provides the basic authority for the separation of enlisted personnel. Paragraph 16-8 of this regulation sets forth the requirements for early separation of enlisted personnel due to reduction in force, strength limitations, or budgetary constraints. Army policy states that the service of personnel separated under this paragraph will be characterized as honorable.

         a. Propriety:    The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above.

(1) The issue is rejected. The Board carefully examined the applicant’s available record of service and the evidence submitted by the applicant in support of his request for a change in his narrative reason for discharge. The available evidence of record shows that the applicant was honorably discharged under the provisions of Chapter 16-8, AR 635-200, by reason of “reduction in force “ due to a DA imposed bar to reenlistment. The applicant was properly notified as to the reasons of the DA imposed bar and was given the opportunity to appeal the bar prior to his separation. The Board is not empowered to remove a DA imposed bar to reenlistment. Further, this Board is not empowered to remove NCO evaluations from the official record. These issues should be addressed to the Army Board for Correction of Military Records (ABCMR). An application to the ABCMR is enclosed for the applicant’s use. The Board found no evidence of arbitrary or capricious actions by the command. The Board was satisfied that all requirements of law and regulation were met and the rights of the applicant were fully protected throughout the separation process. The Board being convinced that the reason for the discharge was both proper and equitable, voted to deny relief.
        
         b. Equity:       The applicant has not submitted an issue of equity and the ADRB has not otherwise relied upon an issue of equity to change the discharge. The major factors upon which the discharge was based are set forth in Parts III and IV of this decisional document.
