PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a.
The evidence of record shows that on or about 2 October 2002, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l3, AR 635-200, by reason of unsatisfactory performance, with an honorable discharge. He was advised of his rights. The applicant consulted with legal counsel, was advised of the impact of the discharge action, and submitted a statement in his own behalf. The unit commander subsequently recommended waiver of further rehabilitative efforts. The intermediate commander (commanders) reviewed the proposed discharge action and recommended approval with an honorable discharge. On 5 November 2002, the separation authority waived further rehabilitative efforts and directed that the applicant be discharged with a general, under honorable conditions discharge.

         b. On 3 February 2003, the applicant was discharged. At the time of discharge, the applicant had completed 1 year, 11 months, and 13 days of active military service in the period under review and had a total of 11 years,
4 months and 24 days of active military service.

2. Legal/Regulatory Basis for Separation Action : A rmy Regulation 635-200 sets forth the requirements and procedures for administrative discharge of enlisted personnel. Chapter 13 of this regulation, states in pertinent part, that separation proceedings will be initiated for soldiers without medical limitations who have two consecutive failures of the Army Physical Fitness Test. The reason for discharge will be shown as unsatisfactory performance. Service of soldiers separated because of unsatisfactory performance for failure of the Army Physical Fitness Test will be characterized as honorable or general, under honorable conditions.

(4) The issue is accepted. The Board carefully examined the applicant’s record of service during the period of enlistment under review. The evidence of record shows that the applicant requested that his case be considered by an administrative separation board. Further, the available records support that the applicant was entitled to have his case heard by an administrative separation board. The Board noted that the applicant was denied his right to an administrative separation and that the approving authority made no reference to said board or the applicant’s request. In view of the foregoing, the Board determined that the discharge was improper. Accordingly, the Board voted to grant full relief by changing the characterization of service to honorable and changing the narrative reason for separation to Secretarial Authority. This action does not entail a change in RE Code.
