PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 26 September 2000, the applicant was found guilty by a special court-martial of failing to report to his appointed place of duty (000531); willful disobedience of a noncommissioned officer (000531); disrespect toward a superior non-commissioned officer (000304); drinking alcohol while under the age of 21 (000528); resisting apprehension (000304); assault consummated by battery (000526); drunk and disorderly (000304); failing to report to his appointed place of duty (000716); willful disobedience of a superior commissioned officer (000715); drinking alcohol while under the age of 21 (000715); and wrongfully communicating a threat (000715). On 1 November 2000, the applicant was placed on excess leave pending finalization of his discharge proceedings. The record contains a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty). His DD Form 214 indicates that he was discharged under the provisions of Chapter 3, AR 635-200 by reason of court-martial, with a bad conduct discharge and a RE Code of 4. The specific facts and circumstances pertaining to the applicant’s discharge are not contained in the available records .

Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 3, Section IV, establishes policy and procedures for separating members with a dishonorable or bad conduct discharge; and provides that a soldier will be given a bad conduct discharge pursuant only to an approved sentence of a general or special court-martial; and that the appellate review must be completed and the affirmed sentence ordered duly executed.

         a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

         b. Equity:       The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above.

(2) The issue is accepted. The Board carefully reviewed the applicant’s military record and post service accomplishments and found that clemency was warranted. Accordingly, the Board voted to grant partial relief and upgrade the applicant’s characterization of service to general, under honorable conditions. A change in the reason for discharge is not authorized under Federal statute.

(1) The issue is rejected. The applicant’s issue regarding entitlement to a medical board is not within the purview of this Board. This issue must be addressed to the Army Board for Correction of Military Records (ABCMR). An application to the ABCMR is enclosed for the applicant’s use. When making application to the ABCMR regarding a medical issue, applicant’s should obtain copies of all medical records, to include active duty medical records, VA medical records, and any civilian treatment records which are available, and submit them with the application.
