PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 4 October 2001, the applicant was charged with violating a lawful regulation, by kissing PFC, attempting to undo her pants, and grabbing her buttocks three specifications between (000201-000228), (000201-000228), (000201-000228); telling PFC that when she did the groin stretch it excited him, and telling her about an affair he was having with another soldier, and by telling her that he had many women his wife did not know about three specifications between (000501-000531), (000501-000531), (000501-000531); asking PFC to kiss him, and asking her if she was interested in having a sexual relationship with him and his wife or girlfriend two specifications between (000501-000531), (0005-001200); asking 1LT if sexual intercourse felt different to a female depending on whether the man was wearing a condom (010327); said to SPC “what are you doing both of them,” in reference to a sexual relationship with her boyfriend and his brother between (0101-0104); said to SPC I married my wife because she was a good girl, but what I really want is someone that would step out on her husband between (0101-0104); knowingly fraternize with SPC between (0102-010228); and, wrongfully endeavor to influence the testimony of SPC’s (010615). On 22 October 2001, the applicant voluntarily tendered his resignation from the service under the provisions of Chapter 3, AR 600-8-24, resignation for the good of the Service in lieu of trial by a general court-martial. The chain of command recommended approval of the resignation for the good of the service with issuance of an under other than honorable conditions discharge. On 8 January 2002, the Deputy Assistant Secretary (Army Review Boards) directed that the applicant be discharge with a characterization of service of under other than honorable conditions.

         b. On 17 January 2002, the applicant was discharged. At the time of discharge, the applicant had completed 4 years, 8 months, and 8 days of active military service.

Legal/Regulatory Basis for Separation Action : Army regulation 600-8-24 prescribes the policies and procedures governing the transfer and discharge of Army officer personnel. Chapter 3, Paragraph 3-13 outlines the rules for processing request for resignation for the good of the Service in lieu of trial by a general court-martial .

2. Finding(s), conclusion(s), and reason(s) for the Board's decision(s) on issues of propriety and/or equity:

         a. Propriety:    The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above.

(1) and (2) The issues are rejected. The Board carefully examined the applicant’s official record for the period of service under review. There was a full consideration of all faithful and honorable service as well as the infractions of discipline, the extent thereof, and the seriousness of the offenses. The Board also noted the applicant’s contentions and the documents submitted by the applicant in support of his contentions. However, the Board did not find said contentions and documents sufficiently mitigating to warrant an upgrade of the separation under review. The Board determined that the applicant's discharge was appropriate because the quality of his service was not consistent with the Army's standards for acceptable personal conduct and performance of duty by military personnel. By his misconduct, the applicant diminished the quality of his service below that meriting a fully honorable or general discharge. The applicant’s issue regarding a medical discharge is not within the purview of this Board and should be addressed to the Army Board for Correction of Military Records (ABCMR). An application to that board is enclosed with this response. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.

         b. Equity:       The applicant has not submitted an issue of equity and the ADRB has not otherwise relied upon an issue of equity to change the discharge. The major factors upon which the discharge was based are set forth in Parts III and IV of this document.
