PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

	a.  The evidence of record shows that the applicant was charged with striking a SGT in the stomach area; disobeying a lawful order from a noncommissioned officer; and disrespect to a noncommissioned officer.  On 2 May 1988, the applicant consulted with legal counsel and voluntarily requested, in writing, discharge under the provisions of Chapter l0, AR 635-200 in lieu of trial by court-martial.  In this request, the applicant admitted guilt to the offense, or  lesser included offenses.  Further, the applicant indicated that he understood that he could receive an under other than honorable conditions discharge and that the discharge would have a significant effect on eligibility for veteran’s benefits.  The applicant did not submit a statement in his own behalf.  On 4 May 1988, the separation authority approved the discharge with an under other than honorable conditions discharge.  The applicant was to be reduced to the lowest enlisted rank.  

	b.  On 5 May 1988, the applicant was discharged.  At the time of discharge, the applicant had completed 1 year, 6 months, and 15 days of active military service. 

	c.  Evidence of record shows that on 21 April 1988, the applicant was convicted by Special Court-Martial of striking a noncommissioned officer, and disobeying lawful orders by a noncommissioned officer and transferred to the US Army Correctional Facility at Fort Riley, KS, on 2 May 1988.  On 4 May 1988, the separating authority accepted the applicant’s request for discharge under the provisions of Chapter 10, AR 635-200, in lieu of trial by court-martial.  

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel.  Chapter l0 of that regulation provides, in pertinent part, that a member who has committed an offense or offenses for which the authorized punishment includes a punitive discharge may submit a request for a discharge for the good of the service in lieu of trial by court-martial.  The requests may be submitted at any time after charges have been preferred and must include the individual’s admission of guilt.  Army policy states that although an honorable or general discharge is authorized, a discharge UOHC is normally considered appropriate.

	a.  Propriety:	The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

        (2)  The issue is accepted.  The Board carefully examined the applicant’s record of service during the period of enlistment under review.  There was a full consideration of all faithful and honorable service as well as the infractions of discipline, the extent thereof, and the seriousness of the offenses.  The Board determined that the characterization of service was inequitable because the applicant's generally acceptable personal conduct and performance of duty was marred by one day of misconduct in the applicant’s entire period of service.  Given the foregoing, the Board found sufficient length and quality of service to partially mitigate the characterization of service granted.  Accordingly, the Board voted to grant partial relief in the form of an upgrade of characterization of service to general, under honorable conditions.  The Board determined that the reason for discharge was proper and equitable and voted not to change it.
 
        (1)  The issue is rejected.  The Board determined that the applicant’s misconduct diminished the quality of his service below that meriting a fully honorable discharge.
