SECTION A-ANALYSTS ASSESSMENT
l. Facts and Circumstances:
a. Evidence of record shows that on 3 May 1991, the unit commander notified the applicant of initiation of release from active duty under the provisions of Chapter l4, AR 635-200, by reason of misconduct-pattern of misconduct, with a general, under honorable conditions discharge. He was advised of his rights. The applicant consulted with legal counsel, was advised of the impact of the release action, and did not submit a statement in his own behalf. The unit commander subsequently recommended release from active duty. The intermediate commander reviewed the proposed release action and recommended approval of the release action with a characterization of service of general, under honorable conditions. The separation authority directed that the applicant be released from active duty with a characterization of service of general, under honorable conditions.
b. On 28 June 1991, the applicant was released from active duty. At the time of release, the applicant had completed 8 months, and 10 days of active military service in the period under review had a total of 2 years, 8 months, and 18 days of active military service.
2. Legal/Regulatory Basis for Separation Action: Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l4 establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, but a general discharge under honorable conditions or an honorable discharge may be granted.

a. Propriety: The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

(1), (2), and (3) The issues are rejected. The Board carefully examined the applicants record of service during the period of enlistment under review. There was a full consideration of all faithful and honorable service as well as the infractions of discipline, the extent thereof, and the seriousness of the offenses. Notwithstanding the applicants contentions of self-defense, they relate to evidentiary and procedural matters which should have been raised by his defense counsel at the time of the applicants Article 32 investigation and before he accepted nonjudicial punishment under the provisions of the UCMJ. Further, the Board noted that the applicant had accepted nonjudicial punishment on a prior occasion for assaulting a female sergeant by grabbing her collar and pushing her against a wall. The Board found sufficient misconduct to warrant the release action under review. The Board concluded that the applicants release from active duty was appropriate because the quality of his service was not consistent with the Armys standards for acceptable personal conduct and performance of duty by military personnel. The Board, being convinced that the reason for release from active duty and the characterization of service were both proper and equitable, voted to deny relief.
