PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

 a. The applicant’s record contains a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty) which was not authenticated by the applicant because he was not available for signature. This document identifies the reason and characterization of the discharge as honorable, under the provisions of AR 635-200, by reason of demobilization.

         b. On 28 June 1991, the applicant was released from active duty and transferred to Det 1, 131 st Trans Co, 2048 Eden Road, York, Pennsylvania Army National Guard. He was credited with 8 months, and 18 days active service on the enlistment under review.

2. Legal/Regulatory Basis for Separation Action : AR 635-200 sets policies, standards, and procedures to insure the readiness and competency of the force while providing for the orderly administrative separation of soldiers for a variety of reasons. Readiness is promoted by maintaining high standards of conduct and performance.

          a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

          b. Equity:       The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above.

          (1) The issue is rejected. The Board carefully examined the applicant’s record of service during the period of enlistment under review. The record shows that on 11 October 1990 the applicant’s unit (Det 1, 131 st Transportation Company, York, Pennsylvania Army National Guard (PAARNG)) was mobilized in preparation for Operation Desert Shield/Storm. The record also shows that on 28 June 1991 the applicant was honorably released from the active Army upon demobilization from Desert Storm and transferred to the PAARNG. The portion of the applicant’s issue relating to correcting his SF 93 does not fall within the purview of the Army Discharge Review Board. The applicant may apply to the Army Board for Correction of Military Records (ABCMR) to address this concern. A DD Form 149 (i.e., application to the ABCMR) is enclosed for the applicant’s use. The Board being convinced that his release from the active Army was both proper and equitable, voted to deny relief.
