PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 20 June 1990, the applicant was found guilty by a special court-martial of larceny of private property, of a value of about $28.30. He was sentenced to be discharged with a Bad Conduct Discharge. On 26 September 1990, the sentence was approved. The record of trial was forwarded to The Judge Advocate General of The Army for review by the Court of Military Review. On 16 April 1991, the United States Army Court of Military Review affirmed the approved findings of guilty and the sentence. On 27 August 1991, the sentence having been affirmed pursuant to Article 71(c) having been complied with, the sentence was ordered to be executed.

         b. On 6 September 1991, the applicant was discharged. At the time of discharge, the applicant had 2 years, 3 months, and 6 days, service on his current period of enlistment under review and 5 years, and 2 days, total time in service.

Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 3, Section IV, establishes policy and procedures for separating members with a dishonorable or bad conduct discharge; and provides that a soldier will be given a bad conduct discharge pursuant only to an approved sentence of a general or special court-martial; and that the appellate review must be completed and the affirmed sentence ordered duly executed.

         a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

(4) The issue is accepted. The Board carefully examined the applicant’s record of service during the period of enlistment under review. There was a full consideration of all faithful and honorable service as well as the infraction of discipline, the extent thereof, and the seriousness of the offense. The Board does not condone the misconduct that led to the applicant’s trial by a special court-martial and his bad conduct discharge. However, after review of the applicant’s entire record of service, the Board found that clemency was warranted. Accordingly, the Board voted to upgrade the applicant’s characterization of service to general, under honorable conditions. A change in the reason for discharge is not authorized under Federal statute.
