PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 15 January 1997, after careful; consideration of medical records, laboratory findings, and medical examination, the Entrance Physical Standards Board (EPSB) found that the applicant was medically unfit for enlistment in accordance with current medical fitness standards and in the opinion of the evaluating physicians the conditions(s) existed prior to service. On 22 January 1997, medical approving authority approved the findings of the Entrance Physical Standards Board (EPSB). On
7 February 1997, the applicant was informed of the Entrance Physical Standards Board findings. The applicant concurred with the medical proceedings, and requested to be discharged from the service. The unit commander recommended that the applicant be discharged. On 10 February 1997, the separation authority approved the applicant’s separation with an uncharacterized discharge.

         b. On 14 February 1997, the applicant was discharged with an uncharacterized discharge under the provisions of Chapter 5, AR 635-200, by reason of failure to meet procurement medical fitness standards. At the time of discharge, the applicant had 6 months, and 9 days, service on his current enlistment under review.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 provides the basic authority for the separation of enlisted personnel. Paragraph 5-11 specifically provides that soldiers who were not medically qualified under procurement medical fitness standards, when accepted for enlistment, or who became medically disqualified under these standards prior to entry on active duty or active duty training or initial entry training will be separated. A medical proceeding, regardless of the date completed, must establish that a medical condition was identified by appropriate medical authority within six months of the soldier’s initial entrance on active duty, that the condition would have permanently or temporarily disqualified the soldier for entry into the military service had it been detected at that time, and the medical condition does not disqualify the soldier from retention in the service under the provisions of Army Regulation 40-501, chapter 3. The characterization of service for soldiers separated under this provision of regulation will normally be honorable, but will be uncharacterized if the soldier is in an entry level status. Army regulation state that a soldier is in an entry level status if the soldier has not completed more than 180 days of creditable continuous active duty prior to the initiation of separation action.

 (2) The issue is accepted. The evidence of record shows that the applicant was discharged under the provisions of Chapter 5, AR 635-200, by reason of failure to meet procurement medical fitness standards with his service uncharacterized. The Board noted that on 7 February 1997 the applicant was informed of the findings and recommendations of the Entrance Physical Standards Board (EPSB). The Board considers the 7 th of February 1997 the date the applicant’s separation action was initiated. The Board noted that on 7 February 1997 the applicant had already served 186 days on active duty and was no longer in entry-status. Uncharacterized service is only authorized when the individual concerned is in the first 180 days of active military service. In view of the foregoing, the Board determined that the applicant’s characterization of service was improper. Accordingly, the Board voted to grant relief in the form of a fully honorable characterization of service. The Board found the reason for discharge to be both proper and equitable and voted not to change it.
