PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The evidence of record shows that on 23 September 1999, the applicant was charged with AWOL from (990808 to 990831), and wrongfully used with intent to deceive a DA Form 31, request and authority for leave on (990808). On 25 October 1999, the applicant consulted with legal counsel and voluntarily requested, in writing, discharge under the provisions of Chapter l0, AR 635-200 in lieu of trial by court-martial. In this request, the applicant admitted guilt to the offense, or a lesser included offense. Further, the applicant indicated that he understood that he could receive an under other than honorable conditions (UOHC) discharge and that the discharge would have a significant effect on eligibility for veteran’s benefits. The applicant submitted a statement in his own behalf. The unit commander and two intermediate commanders recommended approval with issuance of a general discharge. On 2 November 1999, the separation authority approved the discharge with an under other than honorable conditions discharge. The applicant was to be reduced to the lowest enlisted rank.

         b. On 24 November 1999, the applicant was discharged. At the time of discharge, the applicant had 3 months, and 8 days on his current period of enlistment under review and 6 years, 7 months total time in service with 24 days lost time.

Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l0 of that regulation provides, in pertinent part, that a member who has committed an offense or offenses for which the authorized punishment includes a punitive discharge may submit a request for a discharge for the good of the service in lieu of trial by court-martial. The requests may be submitted at any time after charges have been preferred and must include the individual’s admission of guilt. Army policy states that although an honorable or general discharge is authorized, a discharge UOHC is normally considered appropriate.

         a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

         b. Equity:       The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above.

(2) The issue is accepted. There was a full consideration of all service including the infraction of discipline, the extent thereof, and the seriousness of the offense. The Board does not condone the applicant’s misconduct. However, the Board determined that the characterization of service was inequitable. The Board noted that the applicant’s unit commander and intermediate commanders recommended approval of the applicant’s request for discharge with issuance of a general, under honorable conditions discharge. Furthermore, the evidence of record indicates that the applicant's misconduct was mitigated by service of sufficient merit to warrant an upgrade of the discharge being reviewed. Accordingly, the Board voted to grant partial relief in the form of an upgrade of characterization of service to general, under honorable conditions. Restoration to active duty does not fall within the purview of the Army Discharge Review Board. The applicant should apply to the Army Board for Correction of Military Records for further assistance in this matter. A DD Form 149 (Application for Correction of Military Records) is provided for your use. The Board determined that the reason for discharge was proper and equitable and voted not to change it.
