PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 3 December 1997, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter 5-18, AR 635-200, by reason of entry level status performance and conduct, with an uncharacterized discharge. He was advised of his rights. The applicant waived legal counsel, was advised of the impact of the discharge action, and did not submit a statement in his behalf. The unit commander subsequently recommended separation from the service, and waiver of further rehabilitative efforts. On 10 December 1997, the separation authority waived further rehabilitative efforts and directed that the applicant be discharged with an uncharacterized discharge.

         b. On 15 December 1997, the applicant was discharged with an uncharacterized discharge. At the time of discharge, the applicant had 2 months, and 1 day service on his current enlistment.

         c. The unit commander recommended separation due to the applicant’s failure to adapt to the military for other designated physical or mental conditions. A habit of sleepwalking, whereas he was seen on eight occasions and admits to having had this problem all his life. He reported difficulty staying awake during training and sometimes falling asleep while standing up.

2. Legal/Regulatory Basis for Separation Action: Army Regulation 635-200 provides the basic authority for the separation of enlisted personnel. Paragraph 5-18
, specifically provides for the separation of soldiers on the basis of other physical or mental conditions not amounting to disability under AR 635-40, and excluding conditions appropriate of separation under Paragraph 5-11 or 5-13. Such conditions may include, but are not limited to, chronic airsickness or seasickness, enuresis, sleepwalking, dyslexia, severe nightmares, claustrophobia, and other disorders manifesting disturbances or perception, thinking, emotional control or behavior sufficiently severe that the soldier's ability to effectively perform military duties is significantly impaired. The characterization of service for soldiers separated under this provision of AR 635-200 will normally be honorable, unless the soldier is in an entry-level status. Soldiers in an entry-level status will be separated with service uncharacterized. A soldier is in an entry-level status if the soldier has not completed more than 180 days of creditable continuous active duty prior to the initiation of the separation action.
