PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The evidence of record shows that on 2 February 1990, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l3, AR 635-200, by reason of unsatisfactory performance, with a general discharge. He was advised of his rights. The applicant acknowledged notification, consulted with legal counsel, was advised of the impact of the discharge action, and did not submit a statement in his own behalf. The unit commander reviewed the proposed discharge action and recommended approval. On 6 February 1990, the separation authority waived further rehabilitative efforts and directed that the applicant be discharged with a general discharge.

         b. On 14 February 1990, the applicant was discharged. At the time of discharge, the applicant had 2 years, 5 months on his current enlistment.

         c. The unit commander recommended the applicant be separated from the Army due to his numerous counseling statements. The applicant was counseled for missing formation, dishonored checks, fighting in the barracks, and his inability to pay his bills and child support. He was also counseled for failing the physical fitness test. It appears the applicant was placed on limited physical activity on 22 November 1989 for 4 weeks due to a right knee injury and that the retest was administered on 23 November 1989. The applicant has no nonjudicial punishment other than a letter of reprimand for driving while intoxicated.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 13 contains the policy and outlines the procedures for separating individuals for unsatisfactory performance, and provides, in pertinent part, that commanders will separate a member under this chapter when, in the commander's judgment, the member will not develop sufficiently to participate satisfactorily in further training and/or become a satisfactory soldier. Army policy states that a general discharge, under honorable conditions is normally considered appropriate, but an honorable discharge may be granted in meritorious cases.

          a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

(1-3) The issues are rejected. The Board carefully examined the applicant’s record of service during the period of enlistment under review. The Board acknowledges the applicant's successful transition to civilian life and noted the accomplishments outlined in his application and/or in the documents with his application. However, the Board found that the applicant's discharge was appropriate because the quality of service was not consistent with the Army's standards for acceptable personal conduct and performance of duty by military personnel. The applicant provided no independent corroborating evidence demonstrating that either the command's action was erroneous or that the applicant’s service mitigated the misconduct or poor duty performance. Additionally, the US Army does not have, nor has it ever had, a policy to automatically upgrade discharges. Each case is decided on its own merits when an applicant submits a DD Form 293 requesting a change in discharge. The Board was satisfied that all requirements of law and regulations were met and the rights of the applicant were fully protected throughout the separation process. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
