PART IV - PREHEARING REVIEW
SECTION A-ANALYSTS ASSESSMENT
l. Facts and Circumstances:
a. Evidence of record shows that on 25 April 1995 the applicant was discharged from the U.S. Army National Guard and the Reserve of the Army. The Adjutant General, Commonwealth of Pennsylvania ORDERS 077-042, discharged the applicant from the Army National Guard and the Reserve of the Army under the provisions of NGR 600-200, Chapter 8-26q, by reason of misconduct-unsatisfactory participation with an under other than honorable conditions discharge. Under the provisions of NGR 600-200, Chapter 6-44b, he was reduced to the grade of private/E-1 by reason of misconduct, effective 24 April 1995. The record also contains a properly constituted NGB Form 22 (Report of Separation and Record of Service) discharging the applicant from the Pennsylvania Army National Guard. His NGB Form 22 also indicates that he was discharged under the provisions of Chapter 8-26q, NGR 600-200 by reason of misconduct-unsatisfactory participation, with a characterization of service of under other than honorable conditions. The specific facts and circumstances leading to the applicants discharge are not contained in the available records.
b. On 25 April 1995, the applicant was discharged from the Pennsylvania Army National Guard and the Reserve of the Army. At the time of discharge, the applicant had completed 7 years, 1 month, and 3 days of active military service.
2. Legal/Regulatory Basis for Separation Action: National Guard Regulation (NGR) 600-200 and Army Regulation 135-91 govern procedures covering enlisted personnel management of the Army National Guard. Chapter 8 of NGR 600-200 covers, in pertinent part, reasons for discharge and separation of enlisted personnel from the State Army Reserve National Guard. Paragraph 8-26(q), then in effect, provided that individuals could be separated for acts or patterns of misconduct. Army Regulation 135-91, in pertinent part, stated that a member was an unsatisfactory participant when an enlisted member accrued nine or more unexcused absences from scheduled drills during a 1 year period. In conjunction with State Army National Guard discharge regulations, AR 135-178, Chapter 7, prescribed procedures to discharge Reserve of the Army enlisted personnel for misconduct. The service of an individual discharged for misconduct was normally characterized as under other than honorable conditions.

(2) The issue is accepted. The Board carefully examined the applicants record of service during the period of enlistment under review. There was a full consideration of all faithful and honorable service as well as the infractions of discipline, the extent thereof, and the seriousness of the offenses. The Board found that the length and quality of the applicants service partially mitigated his misconduct. In view of the foregoing, the Board determined that the characterization of service was inequitable. Accordingly, the Board voted to grant relief in the form of an upgrade of characterization of service to general, under honorable conditions. The Board determined that the reason for discharge was proper and equitable and voted not to change it.
