PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The evidence of record shows that on 16 September 1995, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter 7, AR 135-178, misconduct-abuse of illegal drugs, with an under other than honorable conditions (UOHC) discharge. He was advised of his rights. The applicant acknowledged notification, waived legal counsel, was advised of the impact of the discharge action, and did not submit a statement on his behalf. The unit commander subsequently recommended approval of the discharge action and forwarded it through command channels to the separation authority. The intermediate commander and MSC commander reviewed the proposed discharge action and recommended approval with a general, under honorable conditions discharge. The staff judge advocate recommended separation with an UOHC discharge. On 9 December 1995, the separation authority directed that the applicant be discharged with an UOHC discharge.

         b. On 9 December 1995, the applicant was discharged with an under other than honorable conditions discharge, under the provisions of Chapter 7, AR 135-178, by reason of misconduct-abuse of illegal drugs. He was credited with 1 year,
1 month, and 1 day active service on the enlistment under review.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 135-178 (Separation of Enlisted Personnel) provides for the separation of enlisted personnel of the Army Reserve and Army National Guard. Chapter 7 of the regulation, in effect at the time, governed separation for acts or patterns of misconduct, including unsatisfactory participation. The regulation provided that the separation authority could disapprove the commander’s recommendation for
discharge for misconduct and direct disposition by other means, disapprove the recommendation for separation for misconduct and direct separation for unsatisfactory performance, or convene a board of officers to determine whether the service member should be separated for misconduct. When discharged under this provision, Army policy states that the characterization of service will normally be under other than honorable conditions. The regulation also permitted the characterization of service as under honorable conditions, but did not authorize the characterization of service as honorable.

          a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

          b. Equity:       The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above.

 (3) The issue is accepted. The Board carefully examined the applicant’s record of service during the period of enlistment under review. There was a full consideration of all service including the reason for separation. The Board determined that the discrediting entry was mitigated by the length and quality of the applicant’s overall service record. Accordingly, the Board voted to grant partial relief in the form of an upgrade of characterization of service to general, under honorable conditions. The Board determined that the reason for discharge was proper and equitable and voted not to change it.

 (1) and (2) The issues are rejected. The record does not support and the applicant provided no evidence to support his contentions, that his command discharged him due to his interracial relationship with a female soldier; or that his prior use of marijuana was used against him in the separation process. The Board found no evidence of arbitrary or capricious actions by the command. The Board was satisfied that all requirements of law and regulation were met and the rights of the applicant were fully protected throughout the separation process. The applicant, by violating the Army's policy not to possess or use illegal drugs, compromised the special trust and confidence placed in a non-commissioned officer (NCO). The applicant, as an NCO, had the duty to support and abide by the Army's drug policies. By abusing illegal drugs, the applicant knowingly risked a military career and this misconduct diminished the quality of service below that meriting a fully honorable discharge.
