PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

          a. The evidence of record shows that on 23 November 1999, after careful consideration of medical records, laboratory findings, and medical examination, a Medical Evaluation Board (MEB) found that the applicant was medically unfit for retention and determined that the applicant’s condition existed prior to service. The MEB recommended that the applicant should be separated under the provisions of Chapter 5, AR 635-40, by reason of a disability that existed prior to service. On 23 November 1999, competent medical authority approved the findings of the MEB. On 23 November 1999, the applicant submitted a request for separation and waived a Physical Evaluation Board (PEB). On 29 November 1999, the applicant concurred with the findings and recommendation of the MEB. The unit commander and intermediate commander recommended approval of the applicant’s separation based on the findings of the MEB. On 1 December 1999, the separation authority approved for the applicant’s separation under the provisions of Chapter 5, AR 635-40.

         b. On 14 December 1999, the applicant was discharged. She was credited with
1 month, and 25 days active service on the enlistment under review.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-40 governs the evaluation for physical fitness of soldiers who may be unfit to perform their military duties because of a physical disability. Chapter 5 provides for the separation of enlisted soldiers for non-service aggravated conditions that existed prior to service (EPTS) when the soldier requests a waiver of a Physical Evaluation Board (PEB). The characterization of service for soldiers separated under the provisions of Chapter 5, AR 635-40 will normally be honorable unless the soldier is in an entry-level status. The service of soldiers in an entry-level status will be uncharacterized. A soldier is in an entry-level status if the soldier has not completed more than 180 days of creditable continuous active duty prior to the initiation of separation action.
