PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The evidence of record shows that on 13 February 1995, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter 5, AR 635-200 by reason of personality disorder, with an uncharacterized discharge. The applicant declined legal counsel, was advised of the impact of the discharge action, and did not submit a statement on his behalf. The unit commander subsequently recommended approval of the discharge action and forwarded it through command channels to the separation authority. On 14 February 1995, the separation authority waived further rehabilitative efforts and directed that the applicant be discharged with an uncharacterized discharge.

         b. On 16 February 1995, the applicant was discharged. He was credited with
10 days of active service on the enlistment under review.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 provides the basic authority for the separation of enlisted personnel. Paragraph 5-13 provides that a soldier may be separated for personality disorder, not amounting to disability under Army Regulation 635-40, that interferes with assignment to or performance of duty. The regulation requires that the condition is a deeply ingrained maladaptive pattern of behavior of long duration that interferes with the soldiers ability to perform duty. The regulation also directs that commanders will not take action prescribed in this chapter in lieu of disciplinary action, requires that the diagnosis concludes the disorder is so severe that the soldier’s ability to function in the military environment is significantly impaired, and states that separation for personality disorder is not appropriate when separation is warranted under chapter 4, 5, 7, 9, 10, 11, 13, 14, or 15; Army regulation 604-10 or Army Regulation 635-40. Army policy requires the award of a fully honorable discharge in such cases.

         a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

         b. Equity:       The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above:

(1) and (2) The issues are rejected. The Board carefully examined the applicant’s available record of service. In his DD Form 293 and his issues the applicant refers to a discharge under other than honorable conditions and a period of AWOL from his active Army training unit. The applicants official military record received by the Board, however, does not support his contentions that he served in the Army National Guard from 1997 through 1998; that he had a period of AWOL; or that he received a discharge under other than honorable conditions. The available records of evidence show that the applicant enlisted in the Texas Army National Guard on 5 January 1995 and reported for active duty for training on 7 February 1995. On 10 February 1995, at Fort Jackson, South Carolina, he was diagnosed by competent medical authority as having a personality disorder. Based on that diagnosis the applicant was processed for separation under the provisions of Chapter 5, Paragraph 5-13, AR 635-200 by reason of a personality disorder with service uncharacterized. Uncharacterized service simply means that the soldier was in an entry-level status, i.e., in an initial probationary period of service. Any individual who has served for less than l80 days at the time his or her commander initiated separation action, and is not being separated for serious misconduct, will be given an uncharacterized discharge. Based on the evidence of record and the applicant’s request for review, the Board considered the aforementioned discharge, and being convinced that the characterization of service and the reason for discharge were both proper and equitable, voted to deny relief.
