PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The evidence of record shows that on 16 April 1996, the Department of the Army imposed a bar to reenlistment under the Qualitative Management Program (QMP). On 29 April 1996, the unit commander notified the applicant of the Department of Army bar to reenlistment, explained the available options, and advised him of his rights. On 13 May 1996, the applicant acknowledged notification and that he understood the options available to him as a result of the bar to reenlistment and the Enlisted Qualitative Early Separation Program. He elected not to submit an appeal and acknowledged that he understood he would be discharged under the provisions of Paragraph 16-8, Chapter 16, Army Regulation 635-200, within 90 days. On 4 June 1996, Orders 156-0073, Department of the Army, United States Army Field Artillery School and Fort Sill, Oklahoma, discharged the applicant from the Regular Army, effective 13 August 1996.

         b. On 13 August 1996, the applicant was discharged. He was credited with
2 years, 4 months, and 23 days active service on the enlistment under review and
9 years, 1 month, and 14 days total time in service.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 provides the basic authority for the separation of enlisted personnel. Paragraph 16-8 of this regulation sets forth the requirements for early separation of enlisted personnel due to reduction in force, strength limitations, or budgetary constraints. Army policy states that the service of personnel separated under this paragraph will be characterized as honorable.

(1) The issue is rejected. The Board carefully examined the applicant’s record of service during the period of enlistment under review. The evidence of record does not support the applicant’s contention that his chain of command acted in an arbitrary and capricious manner in preparing his Noncommissioned Officer Enlisted Evaluation Report, and no evidence to support it has been submitted by the applicant. The Board was satisfied that all requirements of law and regulation were met and the rights of the applicant were fully protected throughout the separation process. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
