PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l4, AR 635-200, by reason of misconduct, with an under other than honorable conditions discharge. The applicant consulted with legal counsel, was advised of the impact of the discharge action, voluntarily waived consideration of his case by an administrative separation board contingent upon his receiving no less favorable than general discharge and submitted a statement in his own behalf. The unit commander subsequently recommended separation from the Army. The intermediate commander reviewed the proposed discharge action, recommended the conditional waiver be disapproved and recommended approval of the separation action with an under other than honorable conditions discharge. The separation authority waived further rehabilitative efforts and directed that the applicant be discharged with a general, under honorable conditions discharge.

         b. On 16 February 1988, the applicant was discharged with a general, under honorable conditions discharge. At the time of discharge, the applicant had
1 year, 11 months, and 29 days service on his current enlistment.

         c. The unit commander recommended the applicant be separated from the Army because his conduct was a discredit to the U.S. Army and would not be tolerated. He further stated that larceny was a very serious offense and retention would not be in the best interest of the Army.

Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l4 establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, but a general discharge under honorable conditions or an honorable discharge may be granted.

The Board carefully examined the applicant’s record of service during the period of enlistment under review and noted his many accomplishments since departing the service. There was a full consideration of all documents submitted with his application, his testimony before the Board, all faithful and honorable service, the infractions of discipline, and the seriousness of the offenses that led to his discharge. The Board noted the applicant’s allegations of harsh and unfair punishment for his misconduct, but found no evidence of arbitrary or capricious actions by the command and determined that the punishments were not unfair given the nature of the offenses. The Board was satisfied that all requirements of law and regulation were met and the rights of the applicant were fully protected throughout the separation process. Furthermore, the evidence of record reflects the applicant submitted a conditional waiver for a general, under honorable conditions discharge. The Board congratulates the applicant on his accomplishments since separation from active duty, but did not find them to mitigate the reason for discharge. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
