PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The evidence of record shows that on 22 February 1993, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l3, AR 635-200, by reason of unsatisfactory performance, with a general discharge. The applicant acknowledged notification, consulted with legal counsel, was advised of the impact of the discharge action, and did not submit a statement in his own behalf. The unit commander subsequently recommended separation from military service due to the applicant’s repeated failure of the Army Physical Readiness Test, and waiver of further rehabilitative efforts. On undated and unsigned, the separation authority waived further rehabilitative efforts and directed that the applicant be separated with a general discharge.

         b. On 1 March 1993, the applicant was separated with a general, under honorable conditions discharge. At the time of discharge, the applicant had 2 years, 5 months, and 13 days on his current enlistment.

         c. On 13 February 1997, the Army Discharge Review Board met in closed session to consider the applicant’s 960121 request to have his discharge upgraded. Based on the evidence of record, the Board determined that the characterization of service was too harsh and voted to upgrade the discharge to fully honorable. The Board found the reason for separation to be proper and equitable.

Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 13 contains the policy and outlines the procedures for separating individuals for unsatisfactory performance, and provides, in pertinent part, that commanders will separate a member under this chapter when, in the commander's judgment, the member will not develop sufficiently to participate satisfactorily in further training and/or become a satisfactory soldier. Army policy states that a general discharge, under honorable conditions is normally considered appropriate, but an honorable discharge may be granted in meritorious cases.

         a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

         b. Equity:       The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above:

(1) The issue is rejected. The Board carefully examined the applicant’s record of service during the period of enlistment under review and heard his testimony. The Board noted that as a result of a previous application to the Board the applicant’s general under honorable conditions discharge was upgraded to fully honorable. In his current application to the Board the applicant requests that blocks 26 (Separation Code) and 27 (Reentry Code) of his DD Form 214 (Certificate of Release or Discharge from Active Duty) be changed so that he may serve in the Reserve. Block 26 of the applicant’s DD Form 214 reflects a code of JHJ which is the appropriate separation code for individuals discharged under the provisions of Chapter 13, AR 635-200, by reason of unsatisfactory performance. Changes to block 27 (reentry code) and eligibility for educational benefits under the Veterans Administration do not fall within the purview of this Board. The Board again noted that the applicant was recommended for separation for his repeated failure of the Army Physical Readiness Test and found the reason to be supported by the evidence of record. The Board was convinced that the narrative reason for separation was both proper and equitable and voted to deny relief.
